HomeMy WebLinkAboutOrdinance 4912 ORDINANCE NO . OFFICIAL RECORD CITY SECRETARY AN ORDINANCE CLOSING AND VACATING A PORTION FT. WORTH, TM OF THE DRAINAGE AND UTILITY EASEMENT IN LOT 21, BLOCK 1, NORTHCREST ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described portion of the drainage and utility easement existing in Lot 21, Block 1, Northcrest Addi- tion to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby extinguished, vacated, closed and permanently abandoned as an easement for drainage and utility facilities: Beginning at a point in the south line of E1 Dorado Drive, said point being 15 feet east of, measured at 90 degrees, the west line of Lot 21, Block 1, Northcrest Addition to the City of Fort Worth; thence south along a line 15 feet east of and parallel to the west line of said Lot 21 to a point 15 feet north of, measured at 90 degrees, the south line of said Lot 21; thence westerly along a line 15 feet north of and parallel to the south line of said Lot 21 to a point 5 feet east of, measured at 90 degrees, the west line of said Lot 21; thence north along a straight line 5 feet east of and parallel to the west line of said Lot 21, to the southerly right of way line of El Dorado Drive; thence easterly along the south line of El Dorado Drive to the point of beginning. SECTION 2 . That the interest of the City of Fort Worth in the fee to the land in said portion of the easement is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3 . That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Dorado Drive, has requested that the City close and permanen east 10 feet of a 15 foot wide drainage and utility easement along the west line of this lot. The residence proposed for the lot, for which plans are complete, would extend into the existing easement. The private utility companies have been consulted and offer no objection to the proposed closing. The remaining 5 feet of the utility easement is ade- quate to serve their needs. The Public Works Department advises that a storm drain easement is needed on the south 15 feet of the easement, which has been reserved. Other City Departments contacted offer no objection to closing this portion of the easement as requested. The City WAR-Commission, on June 5, 1963, recommended that the requested section of the easement be closed, except for 15 feet retry,-,ned for drainage, and recommended that an ordinance be adopted closing the east 10 feet of the 1.5 foot wide easement adjoining the west line of Lot 21, Block 1, Northwest Addition between the south line of E1 Dorado Drive and a line 15 feet north of the rear line of Lot 21, as shown on the attached plat.
