ORDINANCE NO. ~LyZ~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING A PORTION OF A UTILITY EASEMENT LYING ON, OVER
AND WITHIN LOT C-1~-D, BLOCK 13 OF THE WAVERLY PARK ADDI-
TION, SECTION 3, TO THE CITY OF FORT WORTH, AS MORE
SPECIFICALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE portion of a utility easement lying on, over and
within Lot C-1-D, Block 13 of the Waverly Park Addition, Section 3,
to the City of Fort Worth, said portion being described more specif-
ically in Exhibit "A" attached hereto and incorporated herein by
reference for all purposes, be and the same is vacated, abandoned,
and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

RECUf1P1ENDATION
It is recommended that the City Council adopt an Ordinance vacatiny the southerly
40' x 142.48' section of an east/west 45' x 142.48' portion of an existing
utility easement as recorded in Volume 388-51, Page 2O, P.R.T.C.T.

Chris Tabor, owner of abutting property, has requested that the City vacate the
above-described section of utility easement.
The subject section of utility easement, acquired by dedication, is platted, but
contains no utility facilities. The subject vacation request is made in order to
utilize the vacated easement as part of the subject property, thus expanding the
building area and providing more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth. Reviewing City departments and private utility companies have raised
no objections to this request.
