ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 25, "PLANNING", OF THE CODE
OF THE CITY OF FORT WORTH ( 1986) , BY ELIMINATING THE POSI-
TION OF ALTERNATE MEMBER ON THE ZONING COMMISSION OF THE
CITY OF FORT WORTH; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE
DATE .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECT ION 1 .
That the Code of the City of Fort Worth ( 1986) , as amended, is
hereby amended by revising Section 25-71 thereof to read as follows:
"Sec. 25-71. Creation; appointments.
"There is hereby created a Zoning Commission of the
City to be composed of nine (9) qualified electors of the
City. It is the declared policy that the City Council will
consider for appointment to the Commission as members only
those persons who have demonstrated their civic interest,
general knowledge of the community, intelligent judgment,
understanding of zoning and planning and availability to
prepare for and attend meetings and who, by reason of
diversity of their individual occupations, constitute a
commission which is broadly representative of the com-
munity."
SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1964),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.

SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4 .
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption in the
minutes of the City Council and by filing the ordinance in the ordi-
nance records of the City.
SECTION 5 .
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Background
Section 25-7'1 of the Code of the City of Fort Worth provides for the
creation of a Zoning Commission to be' composed of nine qualified
electors of the City. This section also authorizes the City Council to
appoint one qualified elector as an alternate member who shall sit as a
member of the Zoning Commission in the absence of one or more of the
regular members.
Proposal
It is proposed that the City Council amend Section 25-71 to eliminate
the position of alternate member on the Zoning Commission. Section 25-71
of the City Code provides that the Council will consider for appointment
to the Commission only those persons who have demonstrated civic inter-
est and an availability to prepare for and attend meetings. Therefore,
it is my opinion that by appointing members to the Zoning Commission who
meet these qualifications, there is no need to appoint an alternate
member.
Legality
The Department of Law has researched this matter, and there are no known
legal impediments.
