I � AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO . 3011 , AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICT AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS" , PROVIDING FOR INTER- PRETATION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDI- NANCES AFFECTING ZONING; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1 . That Ordinance No . 3011 be and is hereby amended so ,that permitted uses in the herinafter described area be altered, changed, and amended as follows : Z-78-011 Lots B and C and the North 10 ' of Lots E and F, Block 45 , Arlington Heights Addition, lst Filing (4915 Byers Avenue ) From "C" Apartment to "E" Commercial Z-78-012 Lots 79 thru 84, Block 3/8 , J. A. Lee of the Fields-Welch Addition ( 1011 thru 1021 6th Avenue) From "D" Apartment to "F-R" Restricted Commercial Z-78-013 East 65 ' of Lots 12 & 13 , Block 2, Mineral Wells Addition ( 1612 North Handley Drive) From "C" Apartment to "E" Commercial Z-78-015 BEGINNING at a galvanized iron rod in the most westerly south line of the George Hamilton Survey and the north line of the J. Sise Survey, and being in the east line of the. right-of-way of the M. K. & T. Railroad Company and in the middle of County Road No . 1078; and from saidbeginning point a one inch iron rod bears S 80 21+ ' E, 25 . 2 feet ; THENCE N 890 45 ' E, along the common line of the Sise and Hamilton Surveys , and continuing in said road, in all, 2485 . 6 feet to a point in the south line of the J . B. Renf ro Survey and a north line of the Hamilton Survey, whence a one inch iron rod, the northwest corner of the 2 .66 acres described in the deed to B. D. Pearson recorded in volume 2939, page 408 of the Deed Records of Tarrant County, Texas , bears S 000 07 ' E, 30 feet ; -2- THENCE 2-THENCE S 00 07 ' E, 365 . 9 feet to a one inch iron rod, the southwest corner of said 2 .66 acre tract ; THENCE N 890 53 ' E, 280 . 2 feet to the northwest corner of Parcel 36 described in the deed to the State of Texas recorded in volume 4935, page 337, of the Deed Records of Tarrant County, Texas ; THENCE Southerly, along the westerly line of said Parcel , S 00 07 ' E, 281 . 2 feet to the beginning of a curve to the left with a radius of 3045 . 83 feet ; and along said curve 597. 1 feet to the end of the curve; and S 11° 22 ' E, 1383 . 8 feet to a one inch iron rod, the southwest corner of said State of Texas tract , and in the north line of a 10 acre tract described in a deed to B. R. Bradford recorded in Volume 1755, page 457, of the Deed Records of Tarrant County, Texas ; THENCE S 890 57 ' W, 2717 feet to a one inch rod, the northwest corner of said Bradford 10 acre tract , and in the east line of the right-of-way of the M. K. T. Railroad Company; THENCE N 08° 24 ' W, along the east line of said right-of-way, being parallel to and 50 feet from the tract center, 2615 . 9 feet to the place of beginning, and containing 157 . 431 acres , of which 1 .71 acres are in County Road No . 1078 , leaving a net area of 155 . 721 acres . (9750 South Freeway) From "I" Light Industrial to "J" Light Industrial Z-78-016 Lots 1 and the West 150 ' of A, Block 24, Southland Terrace (4775 South Freeway) From "E-R" Restricted Commercial to "E" Commercial SECTION 2 . That the zoning regulations and districts , as herein estab- lished, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets ; to secure safety from fire, panic , flood and other dangers; to provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements . They have been made after a full and complete public hearing, with reasonable consideration, among other things , of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. SECTION 3 . That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances , except in those instances where provisions of such ordi- nances are in direct conflict with the provisions of this -3- ordinance . SECTION 4. That all rights or remedies of the City of Fort Worth, Texas , are expressly saved as to any and all violations or Ordinance No . 3011 or of any amendments thereto of said City of Fort Worth, Texas , that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations , the court shall have all of the powers which existed prior to the effective date of this ordinance . SECTION 5 . It is hereby declared to be the intention of the City Council that the sections , paragraphs , sentences , clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such voidness , ineffectiveness or unconstitutionality shall not affect any of the remaining phrases , clauses, sentences , paragraphs or section of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sen- tence , paragraph or section. SECTION 6 . That any person, firm or corporation who violates , disobeys , omits , neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars ($5 . 00) , nor more than Two Hundred Dollars ( $200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense . SECTION 7. That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publications , as required by law, and it is so ordained.
