AN ORDINANCE AMENDING CHAPTER 39 , 1°WRECKERS" OF THE CODE
OF THE CITY OF FORT WORTH, TEXAS ( 1964) , AS AMENDED, BY
AMENDING SECTION 39-21 THEREOF TO INCREASE CHARGES AUTHOR-
IZED FOR THE STORAGE OF VEHICLES IMPOUNDED BY THE CITY OF
FORT WORTH; TO ESTABLISH AN IMPOUNDMENT FEE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES ; REPEALING ALL
ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN
CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS :
SECTION 1 .
That Section 39-21 of Chapter 39 of the Code of the City of
Fort Worth ( 1964) , as amended, be and is hereby amended so that the
same shall hereafter be and read as follows :
"Section 39-21 . Storage and pound fees .
"The City of Fort Worth shall charge a storage fee of
two dollars ( $2 .00) per day with each day computed on a
basis of twenty-four ( 24) hours , commencing with the time
the vehicle is placed in storage . This fee of two dollars
( $2 .00) will be charged for the first five ( 5) days said
vehicle is in storage . Commencing with the sixth ( 6th)
twenty-four (24) hour period of storage, the City of Fort
Worth will charge a storage fee of five dollars ( $5 .00)
per day with each day computed on a basis of twenty-four
( 24) hours . The City shall also charge an impound fee of
five dollars ( $5 .00) per impoundment . "
SECTION 2 .
That this ordinance shall be cumulative of all provisions of
the Code of the City of Fort Worth ( 1964) , as amended, with respect
to authorized charges for the storage of vehicles by the City of
Fort Worth and establishment of an impoundment fee to be charged. In
those instances where the provisions of this ordinance are in direct
conflict with the provisions of such Code, said conflicting
provisions of such Code are hereby repealed.
SECTION 3 .
That if any section, part of a section, or provision of any
section of this ordinance shall be held to be void, ineffective or
unconstitutional by a court of competent jurisdiction, the holding
of such section, part of a section or provision of any section to be
void, ineffective or unconstitutional for any cause whatsoever shall
in no way affect the validity of the remaining sections and
provisions of this ordinance, which shall remain in full force and
effect . The City Council would not have passed any sections , parts
of sections or provisions of any section of this ordinance that were
unconstitutional, void or ineffective if it had known that they were
unconstitutional , void or ineffective at the time of adopting this
ordinance.
SECTION 4.
That this ordinance shall become effective and be in full force
and effect from and after the date of its passage, and it is so
ordained.

The Fort Worth Police Department Auto Pound is approaching a serious space
problem. Insurance companies and the public in general are finding the lot
to be the cheapest storage facility in town. Consequently, the vehicles
remain in storage while adjustors, lien-holders and the like take their
time in deciding disposition. If this practice continues, the Police Depart-
ment Pound may find itself in a "No Vacancy" situation.
One way to alleviate this problem would be to increase the daily storage fee
from two ($2.00) dollars per day to five ($5.00) dollars per day after a
stated period of storage. It is proposed that the storage fee escalate after
the fifth 24 hour period.
Recommendation
It is recommended that the City Council adopt the attached amendment to the
Wrecker Ordinance.
