ORDINANCE NO. AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COSTS OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF WILSON ROAD IN THE CITY OF FORT WORTH, TEXAS, i FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED, AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE. WHEREAS, the City Council of the City of Fort Worth, I Texas has heretofore ordered that the hereinbelow mentioned portion of Wilson Road in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing ; thereon a 1 inch Not Mix Asphaltic Concrete Surface on a 71 inch Flexible Base, together with combined concrete curbs and gutters where same are not already constructed on proper grade and line, together with incidentals and appurtenances including drains where necessary, all as provided in the Plans and Specifications for such improvements, and contract therefor has been made and entered into with Texas Bitulithic Company; and, WHEREAS, the City Council of the said City has caused Ithe Director of Public Works to prepare and file estimates hof the cost of such improvements, and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1 . Such estimates be, and they are, adopted and approved. I SECTION II. It is hereby found and determined that the cost of improvements on such portion of Wilson Road, with the amounts per front foot proposed to be assessed for such improvements against the abutting property and the owners thereof, are as I!! follows, to wit: ! On WILSON ROAD, from the easterly line of Jenson Road to the northerly line of Pyron Avenue: the estimated cost of the improvements is 7L1 �. on the estimated amount per front foot to be assesse again9t'a5uttir.Q property and the owners thereof for curb and gutter is $ ,Z.°0 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $ 3.10 total estimated amount per front foot to be assessed against abutting property and the 1! owners thereof is $ $. 10 SECTION III. i A hearing be given and held by and before the City JCouncil of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portion of Wilson Road 'and to all others owning or claiming any interest in any such ;property. Such hearing shall be given and held on the �r� day of Jud Y A. D. , 1954, at /O.•oo o 'crock, A �I. , in the o-uuncil Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and I I i i provisions of the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 1106 of the Acts of said Session, now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas . Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of bort Worth, Texas, the first publication to be made at ( least ten (10) days before the date of said hearing and said notice shall comply with and be in accordance with the terms and provisions of said Act. At said ! time and place all owning or claiming any such abutting property for any interest therein shall be and appear and will be fully ! heard concerning said improvements, the cost thereof, the amounts to be assessed therefor, the benefits to the respective parcels of abutting property by means of the improvements on the portion of Wilson Road upon which the property abuts and concerning the regularity, validity and sufficiency of the , contract for, and all proceedings relating to such improvements land proposed assessments therefor, and concerning any matter las to which they are entitled to hearing under the law in `force in the City of Fort Worth under which these proceedings }are taken and had and under the proceedings of the City with reference to said matters .
