WGIRM ORDINANCE DETERMINING THAT IT IS NOT PRACTICAL TO PROCEED WITH THE CONSTRUCTION OF IMPROVEMENTS HERETOFORE ORDERED ON A PORTION OF ELLIS AVENUE IN THE CITY OF FORT WORTH, TEXAS, DETERMINING THAT SAID PORTION OF ELLIS AVENUE SHALL BE IMPROVED BY WIDENING SAME TO CERTAIN WIDTHS HEREIN SPECIFIED, ADOPTING NEW PLANS FOR THE IMPROVEMENT OF A PORTION OF ELLIS AVENUE, ADOPTING NEW ESTIMATES OF THE COST OF SUCH IMPROVEMENTS, FIXING TIME AND PLACE FOR NEW HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED, DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH NEW HEARING, REPEALING, ANNULLING AND RESCINDING THAT PORTION OF ORDINANCE NO. 4338 AND THAT PORTION OF ORDINANCE NO. 4356 WHICH RESPECTIVELY RELATE TO ESTIMATES OF THE COST OF IMPROVEMENTS TO BE CONSTRUCTED ON SAID PORTION OF ELLIS AVENUE AND TO THE ASSESSMENTS HERETOFORE LEVIED AND FIXED ON AND AGAINST THE PARCELS OF PROPERTY ABUTTING ON SAID PORTION OF ELLIS AVENUE AND THE OWNERS THEREOF, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANNCE IN THE APPROPRIATE RECORDS OF THIS CITY. WHEREAS, by virtue of sundry proceedings passed by the City Council of the City of Fort Worth, Texas, the hereinafter described portion of Ellis Avenue in said City was ordered improved by widening same so as to create and construct a 60 foot permanent roadway thereon; and, WHEREAS, by virtue of said proceedings it was determined that a portion of the costs of said improvements was to be specially assessed against the several parcels of property abutting on the hereinafter described portion of Ellis Avenue and against the respective owners thereof; and, WHEREAS, Notice of Benefit Hearing was duly given as provided by law to all owning or claiming any property abutting upon the hereinafter described portion of Ellis Avenue, to wit: ELLIS AVENUE, from the northerly line of Northwest Twenty-Third Street to the Southerly line of Northwest Twenty-fifth Street, known and designated as Unit No, 6; and, WHEREAS, the Benefit Hearing was duly held at the time and place provided in the aforementioned notice and pursuant thereto the City Council did, on August 26, 1960, pass Ordinance No. 4356 which closed said Benefit Hearing and levied assessments on and against the several parcels of property which abut on the portion of Ellis Avenue hereinabove described and against the owners thereof, as well as against other parcels of property abutting on other portions of streets ordered improved; and, - 1 - WHEREAS, on September 2, 1960, the City Council did reopen and continue said hearing, but did on said date again pass and adopt said Ordinance No. 4356 in full; and, WHEREAS, it has now been determined that the interests of the City and of the owners of the respective parcels of prop- erty abutting on that portion Of Ellis Avenue hereinabove des- cribed could be best served by reducing the width of said here- inabove described portion of Ellis Avenue heretofore ordered improved as a 60 foot street, to a 56 foot street from Twenty- Third Street to Twenty-Fourth Street, to a 542 foot street from Twenty-Fourth Street to Exchange Avenue, and to a 56 foot street from Exchange Avenue to Twenty-Fifth Street, all widths being from face of curb to fact. of curb, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. It is hereby determined that it is not practical to proceed with widening the hereinabove described portion of Ellis Avenue to a width of 60 feet, from fac-6 of curb to facie of curb, but to the contrary, same is hereby-btdered to be widened and improved as a street 56 feet wide from Twenty-Third Street to Twenty-Fourth Street, 542 feet wide from Twenty-Fourth Street to Exchange Avenue, and 56 feet wide from Exchange Avenue to Twenty-Fifth Street, all widths being from -,Padt of curb to facCe of curb. That portion of Ellis Avenue to be improved which lies in and between Exchange Avenue and Twenty-Fifth Street shall be improved by raising, grading and filling same and by construct- ing thereon a 4 inch gravel. base with a 6 inch reinforced concrete base thereon and a 12 inch hot mix asphaltic concrete surface, with combined concrete curbs and gutters on proper grade and line where same are not already so constructed. Those portions of that portion of Ellis Avenue to be improved which lie in and between Twenty-Fourth Street and Exchange Avenue and Twenty-Third Street and Twenty-Fourth Street, shall be improved by widening, raising, grading and filling said widened areas with a 4 inch treated subgrade, by constructing thereon a reinforced concrete base and by further constructing on the entire roadway a hot mix asphaltic concrete level-up course with a 12 inch hot mix asphaltic surface, together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed. II. New Plans having been prepared and submitted by the Public Works Director, same being now before the City Council and having been examined and found to be in all respects proper, said New Plans are hereby adopted and approved. 2 New estimates of the costs of the improvements to be constructed on that portion of Ellis Avenue hereinabove des- cribed having been prepared by the Public Works Director, same now being before the City Council and having been examined and found to be in all matters proper, said new estimates are hereby adopted and approved, and it is hereby found and determined that the cost of the improvements to be constructed on the herein- after described portion of Ellis Avenue, with the amount or amounts per front foot proposed to be assessed for such improve- ments against abutting property and the owners thereof, are as follows, to wit: ELLIS AVENUE, from the Northerly line of Northwest Twenty-Third Street to the Southerly line of Northwest Twenty- Fifth Street, known and designated as Unit No. 6: the estimated cost of the improvements is $ -5-0 91_F- 8� the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $2.00; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $11.33; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $13.33. IV. A new hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portion of Ellis Avenue, as well as to all owning or claiming any interest in any such property. Such new hearing shall be given and held on the 13 day of X,4NII.49 Y —, 1961 , at 9; .00 O'clock, A in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such new hearing and of other matters and facts in accordance with the terms and provisions of an Act p assed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being shown as Article 1105b of Vernon's Texas Civil Statutes. Such notice shall be by advertise- ment inserted at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten days before the date of said new hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act. The City secretary is further directed to give personal notice of the time and place of such new hearing to all owning or claiming any property abutting on said portion of Ellis Avenue, as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice, postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties, to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notice to any owner or other person claiming an interest in the property to be assessed when the address of such owner or other person is unknown to the City Secretary and cannot be 3 determined by the City Secretary after reasonable investigation. In this connection, the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of new hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary shall be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of new hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise invalidate said new hearing or any assessments levied pursuant to said new hearing, but notice of new hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. V. The estimates of the costs of improvements to be con- structed on that portion of Ellis Avenue hereinabove described as found and determined by Ordinance No. 4338, are hereby cancelled, annulled and rescinded. The assessments levied against the respective parcels of abutting property ory that portion of Ellis Avenue hereinabove described and against the owners of said property as assessed and levied pursuant to Ordinance No. 4356, are hereby cancelled, annulled and rescinded. All other provisions contained in Ordinance Nos. 4338 and 4356 are hereby ratified, approved and confirmed and shall remain in full force and effect. VI. The City Secretary is hereby directed to engross and enroll this Ordinance by copying the caption of same in the minute book of the City Council and by filing the complete ordinance in the appropriate ordinance records of this City. VII. This ordinance shall take effect and be in full force and effect from and after the date of its passage. APPROVED AS TO FORM AND LEGALITY: City Attorney. - 4 - CITY OF FORT WORTH TEXAS OFFICE OF THE CITY MANAGER Communication to Mayor and Council No. PWO-636 December 16, 1960 Honorable Mayor and Re: Ellis Avenue, Unit 6 of Members of the City Council Assessment Paving at 6 City of Fort Worth Locations (AP 59 18) Project No. 94 B4 8 Mrs. McKnight and Gentlemen: The City Council on August 26, and September 2, 1960, adopted Ordinances No. 4337 and 4356 closing the benefit hearing and levying the assessment on all units of assessment paving at 6 locations, which included Unit 6, Ellis Avenue from 23rd Street to 25th Street. In the latter part of September a petition was submitted by property owners in the 2300 and 2400 blocks of Ellis Avenue protesting the widening and improving of Ellis Ave. Through joint efforts of the Public Works Department and the North Fort Worth Businessmen's Association, a satisfactory agreement has been reached overcoming the major objection of the property owners. This agreement would provide a reduction from the specified 60-foot roadway to a 56 foot roadway, except that portion from 24th Street to Exchange Avenue which would be a 54.5 foot roadway. The reduction of roadway width would eli- minate considerable property damage and would result in a reduced project cost to both the City and the property owners. The reduced roadway width would be sufficient for four lanes of moving traffic and two lanes of parking. It is recommended that an ordinance be adopted providing for a new bene- fit hearing, on this basis of the reduced roadway width, on Ellis Avenue from 23rd Street to 25th Street, and authority be granted the City Secretary to advertise the new benefit hearing in accordance with Article 1105b, Vernon's Texas Civil Statutes. The City Council of the City of Fort Worth, Texas, has heretofore ordered that the hereinafter described portion of Ellis Avenue in the City of Fort Worth, Texas, be improved as follows, to wit: That portion of Ellis Avenue to be improved which lies in and between Exchange Avenue and Twenty-Fifth Street, 'shall be improved by raising, grading and filling same and by constructing thereon a 4 inch gravel base with a 6 inch reinforced concrete base thereon and a lh inch hot mix asphaltic concrete surface, with combined concrete curbs and gutters on proper grade and line where same are not already so constructed. Those portions of that portion of Ellis Avenue to be improved which lie in and between Twenty-Fourth Street and Exchange Avenue and Twenty-Third Street and Twenty-Fourth Street,shall be improved by widening, raising, grading and filling said widened areas with a 4 inch treated subgrade, by constructing thereon a reinforced concrete base and by further constructing on the entire roadway a hot mix asphaltic concrete level-up course with a lh inch hot mix asphaltic surface, together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed. All of the aforementioned improvements are to be con- structed, together with necessary incidentals and appurtenances, as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract has been made and entered into with Texas Bitulithic Company for the making and construction of such improvements. New estimate of the cost of such improvements on said portion of Ellis Avenue have been prepared. The portion of Ellis Avenue so to be improved, together with the estimated cost of the improvements thereon and the amount per front foot proposed to be assessed against the abutting property and the owners thereof, are as follows, to wit: On ELLIS AVENUE, from the Northerly line of Northwest Twenty-Third Street to the Southerly line of Northwest Twenty- Fifth Street, known and designated as Unit M. 6: the estimated cost of the improvements is $ 5'4 91-4 b'Q the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $2.00; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $11.33; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $13.33. - 1 - A new hearing will be given and held by and before the City Council of the City of Fort Worth, Texas, on the /I day of TANVAX , 196 j at 4 : e o o'clock, M.,— in the Council Chamber in the City Hall in the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portion of Ellis Avenue, and to all owning or claiming any interest in any such property. At said time and place, all owning or claiming any such abutting property or any interest therein shall be and appear and will be fully heard concerning said improvements, the cost thereof, the amounts to be assessed therefor, the benefits to the respective parcels of abutting property by means of said improvements on the portion of Ellis Avenue upon which the property abuts and concerning the regular- ity, validity and sufficiency' of the contract for, and all pro- ceedings relating to such improvements and proposed assessments therefor, and concerning any matter as to which they are entitled to hearing under the law in force in the City of Fort Worth, Texas, and under which these proceedings are taken and had and under the proceedings of the City with reference to said matters. Following such new hearing, assessments will be levied against abutting properties and the owners thereof and such assessments, when levied, shall be a personal liability of the owners of such property and a first and prior lien upon the property as provided by the law under which these proceedings are taken and had, being the Act passed at the First Called Session of the Fortieth Legislature of` the State of Texas, known as Chapter 106 of the Acts of said Session, now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas. of all said matters and things, all owning or claiming any such property or any interest therein, as well as all others in anywise interested or affected, will take notice.
