HomeMy WebLinkAboutOrdinance 9687.f= rt .,..~ ORDINANCE NO. ~2~~1~ AN ORDINANCE VACATING , ABANDONING , AND CLOSING AND EXT IN- GUISHING A PORTION OF A 10' UTILITY EASEMENT LYING AND BEING SITUATED IN THE ST ONEGATE ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR REVERSION OF FEE IN SAID LAND (S) ; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECT ION 1 . THAT THE portion of the 10' utility easement described in Exhibit "A" hereto which is incorporated herein by reference for all purposes, said vacated portion lying and being situated in the Stonegate Addition to the City of Fort Worth be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECT ION 3 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DISCUSSION: Jim Kasson, on behalf of Stonegate Multi-Family No. 2, LTD., owner of all abut- ting property, has requested that the City vacate the above-described portion of a utility easement, as shown on the attached map. The subject easement portion, acquired by dedication, is platted but contains no utility facilities. The subject vacation request is made in order to utilize the vacated easement as part of the subject property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department, as required by the Land Agent for the City of Fort Worth.
