HomeMy WebLinkAboutOrdinance 5013 i M ORDINANCE NO.AN.ORDINANCE APPROVING AND ADOPTING ESTIMATES OF COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF YEAGER STREET AND PORTIONS OF SUNDRY OTHER STREP , AVENUES AND PUBLIC PLACES IN THE CITY OF FORT ? , TEXAS; FIRING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEAR- ING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME'IN THE MINUTE BOOK 'OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. ICEREA3. the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing thereon the following, to-wit: 1. YEAGER STREET: From Lancaster Avenue to Beaty Street, known and designated as Unit 11 a 12" Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 2. YEAGER STREET: From Beaty Street to Greenlee Street, known and designated as Unit 21 a 12" Hot-Mix Asphalt Concrete Sur.face. on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 3. YEAGER STREET: From the South line, Lot 8, Block 1, Wildwood Estates ,to Meadowbrook Drive, known and designated as Unit 3, a 12" Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 4. BEATY STREET: From Yeager Street to Stark Street, known and designated as Unit 5, a 12' Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 5. STARK STREET: From Lancaster Avenue to the North line of Lot K, Brown- Harwood Addition, known and designated as Unit 5, a 12" Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 6. CRAIG_STREET: From Lancaster Avenue to Stark Street, known and designated as Unit 6, a lt" Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a twenty (20) foot roadway. 7. NORMA STREET: From the west line of Lot 16, Block 7, Forty Oaks Addition -and designated as Unit 7, a 12" Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 8. LLOYD AVENUE: From Vinson Street to Panola Avenue, known and designated as Unit $, a 12" Hot-Mix Asphalt Concrete Surface on a seven (7) inch Cement Stabilized Base on a thirty (30) foot roadway. 9. PERKINS STREET: From Mt. Vernon Street to Meadowbrook Drive, known and 2" Hot-Mix Asphalt Concrete designated as Unit 91 a 1 Surface on a seven (7) inch Cement Stabilized Base on a twenty-six (26) foot roadway. 10. McGEE STREET: From the North line of Lot K, Mamie Wolfe Addition, to Meadowbrook Drive, known and designated as Unit 10, a 11' Hot-Mix Asphalt Concrete Surface on a seven (7) inch cement Stabilized Base on a thirty (30) foot roadway. together with combined concrete curbs and gutters on proper ,grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and. where shown on the Flans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into with Re ,% GIBBONS INC. and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improve- ments and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estiniates have been examined. NOVI, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORT'H2 TEXAS, THAT: I. Such estimates be, and they are hereby, adopted and approved. II. PERIMIS STREET: From I!t. Vernon Street to Meadowbrook Drive, known and designated as unit 9. The estimated cost of improvements is $ 3,902.58 the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ 1.36 ; the estimated amount per front foot to be assessed against abutting ;property and the oirmers thereof for improvements exclusive of curb and gutter is a 2.87 ; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 4.73 10. MIcGEE STREET: From the North line of Lot K, Miamie VIjolfe Addition to Meadowbrook Drive, known and designated as Unit 10. The estimated cost of improvements is a 5,454.90 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is S 1.86 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is 3.40 ; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 5.26 A hearing will be gi.veA and held by and before the City Council of the City of .Fort ',,'Orth, Texas, on the 16 day of September � 19 63a at 9.30 A.M. in the Council Chamber of the City Hall in the City of Fort Worth, Texas, to allowningor claiming any property abutting upon said portions of streets, avenues and public places, and to all owning or claiming any interest in any such property. At said time and place, all owning or claiming any such abutting property or any interest therein shall appear and will be fully heard concerning said improvements, the cost thereof, the amounts to be assessed therefor, the benefits to the respective parcels of abutting property by means of the improvements on said portions of streets, avenues and public places upon which the property abuts and concerning the regularity, validity and sufficiency of the contract for, and all proceedings relating to such improvements and proposed assessments therefor, and concerning any matter as to which they are entitled to hearing under the law in force in the City of Fort Worth, Texas, and under which these proceedings are taken and had under the proceedings of the City with reference to said matters. Following such hearing, assessments will be levied against abutting properties and the owners thereof and such assessments, when levied, shall be a personal liability of the owners of such property and a first and prior lien upon the property as provided by the law under which these proceedings are taken and had, being the Act passed at the First Called Session of the Fortieth Legisla- ture of the State of Texas, known as Chapter 106 of the Acts of said Session, now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas. The improvements on each said portion of street, avenue and public place constitute an entirely separate and distinct unit of improvements, all to the same extent as if entirely separate and distinct proceedings have been taken and had with reference to the improvements and assessments therefor in connection with the improvements on any such portion of street, avenue and public place, and the assessments against the property abutting upon any one unit shall be and are in nowise affected by any fact or circumstance relating to or connected with the improvements in any of the other units. Of all said matters and things, all owning or claiming any such property or any interest therein, as well as all others in anywise affected or interested, will take notice.
