ORDINANCE N0. ~~~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE 2700 BLOCK OF PROSPECT AVENUE, DESCRIBED MORE
SPECIFICALLY HEREIN, LYING AND BEING SITUATED IN THE M.G.
ELLIS ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR
REVERSION OF FEE IN SAID LAND(S) ; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE Public Street and Right-of-way known as 2700 Block of
Prospect Avenue commencing at the South right-of-way line of State
Highway 183 and extending to the Northernmost right-of-way line of
Cliff Street be and the same is vacated, abandoned, and permanently
closed and extinguished. Said vacated public street and right-of-way
also lies between and adjacent to Lots 14-17, 18A, 19 and 20,
Block 46 of the M.G. Ellis Addition to the City of Fort Worth and
Lots 7-10, and Lot 9A, Block 47 of said addition.
SECTION 2.
That the fee to the land(s) in the above described vacated
public street and right-of-way is hereby released and shall revert
to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that
easements are retained for any and all existing and prospective
utilities and for all existing and prospective drainage require-
ments, as necessary.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

SECTION 4.
That this ordinance shall take effect and be in ful'1 force and
effect from and after the date of its passage, and it is so or-
dained.

Recommendation:
It is recommended that the City Council adopt an Ordinance vacating the 2700
block of Prospect Avenue from S.H. #183 (N.W. Twenty Eighth Street) to Cliff
Street, being more fully described as an 80' wide right-of-way located adjacent
to Lots 14-17, 18-A, 19 & 20, Block 46; and Lots 7, 8, 9-A, & 9-11, Block 47, M G
ELLIS ADDITION, as recorded in Volume 63, Pages 19 & 20, P.R.T.C.T., as recom-
mended by the City Plan Commission.

DISCUSSION:
Ronald, Sam, Maxine and Dorothy Rosen, Jerry Barton, and the City of Fort Worth,
owners of abutting property, have requested that the City vacate the above des-
cribed portion of street right-of-way, as shown on the attached map.
The subject street right-of-way, acquired by dedication, is unimproved, but con-
tains water, sewer, and electric utility facilities, for which the responsible
entities have requested that appropriate easements be retained. The subject
vacation request is made in order to replat the vacated right-of-way with adja-
cent property, to expand the building area, and provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department, as required by the Land Agent for the City of
Fort Worth.
Reviewing City departments and private utility companies have raised no objec-
tions to this request, subject to the vacated right-of-way being replated with
adjacent property, and any required utility easements are retained. Satisfactory
replats have been submitted.
