ORDINANCE N0. ~ ~ ' AN ORDINANCE AMENDING ORDINANCE N0. 9733 OF' THE CITY OF FORT WORTH, AS AMENDED BY ORDINANCE NO. 9751, SAME BEING AN ORDINANCE PROHIBITING THE EST ABLISHMENT OF PAWNSHOPS, THE ISSUANCE OF CERTIFICATES OF OCCUPANCY AND THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION, REPAIR OR RENO- VAT ION OF STRUCTURES TO BE USED FOR PAWNSHOPS WITHIN THE CITY PENDING CONSIDERATION BY THE ZONING COMMISSION AND THE CITY COUNCIL OF RESTRICTIONS REGARDING THE LOCATION OF PAWNSHOPS IN THE CITY OF FORT WORTH, BY EXEMPTING FROM THE PROVISIONS THEREOF CERTAIN LOCATIONS WITHIN THE CITY OF FORT WORTH; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND NAMING AN EFFECTIVE DATE. WHEREAS, on September 30, 1986, the City Council adopted Ordinance No. 9733 which directed the Zoning Commission of the City of Fort Worth to conduct public hearings and to report to the City Council as expeditiously as possible its recommendations relating to proposed amendments to the Comprehensive Zoning Ordinance (Appendix "A" of the Code of the City of Fort Worth), restricting the location of pawnshops within the City of Fort Worth and in par- ticular prohibiting the location of pawnshops within the "E" Com- mercial zoning district of the City of Fort Worth; and WHEREAS, pending the report of the Zoning Commission, Ordinance No. 9733 further prohibited the establishment of pawnshops, the issuance of certificates of occupancy and the issuance of building permits for the construction, repair or renovation of structures to be used as pawnshops within the City of Fort Worth; and WHEREAS, on October 28, 1986, the City Council adopted Ordinance No. 9751 which amended Ordinance No. 9733 by providing that the moratorium with respect to pawnshops shall not be appli- cable to applications for building permits filed prior to September 30, 1986; and WHEREAS, the City Council finds that the moratorium with respect to pawnshops will work a hardship on certain pawnshop locations which had taken necessary steps to license and operate a pawnshop prior to the effective date of the moratorium; and WHEREAS, the City of Fort Worth now desires to amend said Ordinance No. 9733, as amended, to provide that the moratorium with respect to pawnshops shall not be applicable to locations for which a secondhand dealer's license was issued by the City of Fort Worth and an application for a pawnshop license was filed with the State of Texas prior to September 30, 1986, provided that a pawnshop license was issued by the State prior to October 28, 1986. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. That Ordinance No. 9733 of the City of Fort Worth, adopted September 30, 1986, as amended by Ordinance No. 9751, adopted October 28, 1986, is hereby amended by providing that the moratorium with respect to pawnshops shall not be applicable to locations for which a secondhand dealer license had been issued by the City of Fort Worth and an application for a pawnshop license had been filed -2- w :~ ~..` ;4~; :~° ~= with the State of Texas prior to September 30, 1986, provided that a pawnshop license was issued by the State prior to October 28, 1986. Except as provided above, the moratorium enacted by Ordinance No. 9733, as amended by Ordinance No. 9751, shall continue in full force and effect until such time as the City Council adopts an ordi- nance repealing same. Any pawnshop exempted from the moratorium must still comply with all other applicable laws and regulations. SECTION 2 . This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3 . This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained.
