HomeMy WebLinkAboutOrdinance 9592~~' J ~> _ ,~ t- 1 ORDINANCE NO . ~~.~ ./~i AN ORDINANCE AMENDING ORDINANCE N0. 9163, BY AMENDING CERTAIN PROVISIONS OF PARAGRAPH III THEREOF; PROVIDING THAT ALL OTHER PROVISIONS OF SAID ORDINANCE NO. 9163 SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be improved by raising, grading, or filling same and by constructing thereon, to-wit: Alta Mesa Boulevard (Unit II) and portions of sundry other streets, avenues and public places in the City of Fort Worth, Texas, specifically designated as Project No. 030-036691-00. WHEREAS, subsequent thereto, the City Council levied assessments against the property abutting the above-referenced project and the owners thereof, by Ordinance No. 9163; and, WHEREAS, the amounts assessed against certain abutting property and its owner under said Ordinance were determined to be erroneous in that they were less than the amounts for which the landowner was liable based on the benefit accruing to its property as a result of said Project, said error being the result of a clerical mistake; and, WHEREAS, Sullivan Development, Inc. owned the property affected by said erroneous assessments, and subsequently sold the property to Louisiana-Hunt Corporation, which assumed its liability for any paving assessments affecting the property; and, WHEREAS, the provisions of Article 1105(b), Section 13 of Vernon's Annotated Texas Statutes have been complied with in all necessary particulars, said Article authorizing the correction of invalid or unenforceable assessments; and, WHEREAS, it is necessary that those certain amounts levied against such property by Ordinance No. 9163, previously adopted by the City Council, should be corrected to reflect the increased amounts for which the landowner is liable; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: I. o._ Paragraph III of Ordinance No. 9163, previously ,adopted by the City Council on July 31, 1984, be amended in part, such that the assessment roll appearing therein be repl-aced and superceded in its entirety, and as so amended shall hereafter read as follows: ,, _ ,,. II. All other provisions of Ordinance No. 9163 shall remain in full force and effect. III. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete Ordinance in the appropriate Ordinance Records of said City. IV. This ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. Seven-inch thick reinforced concrete turn lanes and median openings will be constructed where specified. S:ix-inch thick concrete driveway approaches will be constructed where required. BACKGROUND On July 31, 1984 (M&C G-8463), the City Council conducted the benefit hearing and adopted Ordinance No 9163 closing the benefit hearing and levied the assessments as proposed on Project No. 30-036691-00, as described below Roadway R.O.W. All of the property adjacent to Unit I, Alta Mesa Boulevard (Unit II), between Crowley Road and Hemphill Street and all of the property adjacent to Unit IB, Hemphill Street are owned by Louisiana-Hunt Petroleum Corporation The assess- ments against their property is based on an interior street to a new develop- ment as indicated on the attached Assessment Roll Louisiana-Hunt Petroleum Corporation has furnished the City with Mechanic's and Materialman's Contracts and Promissory Notes covering the assessments which have been filed with the Tarrant County Deed Records Office. The documents provide for the payment of the assessments in ten (10) equal installments with eight (8) percent interest per annum on the unpaid balance PREPARATION OF ASSESSMENT ROLLS In early 1984, the .Assessment Paving Office began preparing the assessment rolls by computer and they are printed by word processor In preparing the rolls on this project (Unit I only), four printing errors were made which were .~ ~r ~ DATE REFERENCE sue~ECT CORRECTION OF ASSESSMENTS - ALT PAGE NUMBER 3-18-86 ~ G-6607 MESA BOULEVARD (UNIT II), STREW 2oF 2 _`~________ ~_. AAIn CTl1DM nDn rrv TMTDPo_~~GA~IT~C not discovered until June, 1985 The four errors amount to $438,'370 00 in favor of the developer, now Louisiana-Hunt Petroleum Corporation The errors appear on Page 2 and 3 of the attached assessment roll and are indicated by an asterisk with the correct calculation in parenthesis On September 20, 1985, a certified letter was forwarded to Louisiana-Hunt Petroleum Corporat ion, apprising them of the errors and requesting their co- operation in correcting same error. A telephone call from representatives of Louisiana-Hunt revealed that the Corporation was considering alternatives to accept the additional cost The corrected assessment is approximately $400,000 less than the estimated developer cost in the original Community Facilities Agreements It is also the opinion of the staff that the adjacent property wil l be enhanced by as much or more than the amount of the corrected 'assessment On January 9, 198b, representatives of Louisiana-Hunt Petroleum Corporation met with the Transportation and Public Works staff and agreed to accept the additional assessment provided the $438,370 can be paid equally along with the last five payments of the original ten year payout.
