HomeMy WebLinkAboutOrdinance 17982-02-2008ORDINANCE NO. 17982-02-2008 AN ORDINANCE INCREASING TILE TOTAL NUIVIBER OF AUTHORIZED CIVIL SERVICE POSITIONS IN THE POLICE DEPARTMENT; ADDING ONE CORPORAL/DETECTIVE POSITION, REDUCING ONE POLICE OFFICER POSITION; PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION AND IMPLEMENTATION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SIiALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief has requested the City Council to increase and thereafter specify the total number of authorized civil service positions at the police officer rank in the Police Department into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WHEREAS, on November 27, 2007, the City Council approved the most recent ordinance concerning the authorized positions for the Police Department. In that Ordinance, the Council adjusted the Police Department's civil service staffing, effective October 2°d , 2007, as follows: Deputy Chief S Captain 13 Lieutenant 46 Sergeant 1 SS CorporaUDetective 181 Police Officer 1,087 Total 1,487 WHEREAS, pursuant to Chapter 143.021 (a), Texas Local Government Code, the City Council may prescribe the authorized number of positions in each classification (rank) and the correct number of civil service positions by ordinance; 03-03-0 8 P01 -4 0 I IV NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, effective upon the formal adoption of this ordinance, the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Police Department for the remainder of the fiscal year 2007-2008 or until modified by subsequent ordinance: Deputy Chief 5 Captain 13 Lieutenant 46 Sergeant 155 CorporallDetective 182 Police Officer 1,086 'T'otal 1,487 SECTION 2. The "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the Council in their adoption as well as the Department's implementation of this ordinance. SECTION 3. This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. No. 17982-02-2008 DATE: Tuesday, February 12, 2008 LOG NAME: 35STAFFING REFERENCE NO.: G-16047 SUBJECT: Adopt Ordinance Adjusting the Authorized Civil Service Staffing in the Police Department by Adding One Police Corporal/Detective Position and Reducing One Police Officer Position RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance specifying the number of authorized positions in the Police Department, thereby effectively increasing the number of authorized positions by one police corporal/detective position and reducing the number of authorized positions by one police officer position. DISCUSSION: The proposed addition of a police corporal/detective is based on the adoption of Council Proposal No. 208 on April 13, 1999, which provides 2,080 hours of annual leave time for the individual who serves as the Fort Worth Police Officers Association (FWPOA) president. This policy also provides that the FWPOA will reimburse the City for the base pay of the FWPOA president. Benefits for this additional corporal/detective position, including group health, retirement contribution, Medicare, and civil service uniform allowance are included in the Department's General Fund budget. The leave time granted to the FWPOA president by this policy reduces the effective strength of the Police Department by one position. This position of police officer was added by ordinance in 1999. The new president is a corporal/detective so it is necessary to increase the authorized number of corporal/detective positions and reduce one police officer position to maintain the department's existing staffing level. The adjustment of these positions will not result in an increase to the Police Department's current authorized strength. The Police Department's authorized civil service strength is 1,487. Approval of the attached ordinance would result in the following changes effective upon adoption of the ordinance.
