ORDINANCE ACCEPTING IMPROV~'TS ON A PORTION OF _STATE HIGHG~Y
783 (EPHRIHAM AVENUE) AND PORTIONS OF SUNDRY OTHER STREET'S,
AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS;
DECLARING THE CONTRACT WITH THE STATE DEPARTMENT OF HIGH4~IYS AND
PUBLIC TRANSPORTATION FOR THE CONSTRUCTION OF SAID IMPROVIIKIIVTS
FULLY COMPLETED ANO PERFORMED; DIRECTIN3 THE ISSUANCE, EXECUTION
AND DELIVERY OF CERTIFICATES IN EVIDENCE OF ,SPECIAL ASSESSMENTS
LEVIED AFTER GIVING EFFECT ~ SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AMID ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY CAUNCIL OF FORT
WORTHS TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN
APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Gity of Fort Worth, Texas has heretofore entered into a contract
with State Department of Highways and Public Transportation, for the making and construction
of certain street improvements on the hereinafter described portions of streets, avenues and
public places in said City, to wit:
STATE HIGH4~Y 183 From State Highway 199' to Farm Road 1220 (Azle Ave-
(EPHRIHAM AVENUE) nue) known and designated as Project No. 30-035459-00,
a new two-inch thick hot-~tiix asphaltic concrete
pavement with a fabric undersea) on the existing
concrete base and adding eight-inch high concrete
curb and eighteen-inch wide concrete gutter so that
the finished roadway will be sixty-feet wide.
Six-inch thick concrete driveway approaches will be
constructed where required.

~°~HENEAS, by sundry proceedings heretofore pa3sed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 9460 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the abov^ described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHEfi:EAS, the City Council of the City of Fort ~'+orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 9460 , and
WHEf~:A;, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

BE IN ORDAICJED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvement-s on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted, and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.

The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance Vrith
the proceedings relating to such improvements and assessmentse The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereone The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
xv.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,

This ordinance shall take effect and be in full force and effect from and after
the date of its passage,

RECOMMENDATION'
It is recommended that the City Council accept as complete the Reconstruction
of State Highway 183 (Ephriham Avenue) from State Highway 199 to Farm-Market
1220, Project No. 30-035459-00, by adoption of the attached ordinance.

BACKGROUND
On March 12, 1985 (M&C C-8894), the City Council approved State Highway
Commission Minute Order No. 82692 providing for the improvement of State
Highway 183 from State Highway 199 to Farm-Market 1220. On July 23, 1985
(M&C C-9147), the City Council declared the necessity for and ordered the
improvements on State Highway 183. An agreement was authori zed with the State
Department of Highways and Public Transportation whereby the City agreed to pay
the State of Texas $60,495.00 for its total share of construction cost and on
August 20, 1985, the City Council conducted the benefit hearing and levied the
assessments as proposed. (M&C G-6413).
PROJECT COST AND FINANCING
Thi s prof ect has been completed and accepted by the State Department of
Highways and Public Transportation. The City's final share of construction cost
is $60,495.00 as agreed. This amount has been paid and no additional monies are
due the State of Texas. Of the $60,495.00, $24,573.61 was assessed against the
adjacent properties for curb and gutter and driveway approaches where none
existed prior to this project.
COMPLIANCE WITH SPECIFICATIONS
This project has been completed in accordance with the requirements of the
State's contract.
