ORDINANCE N0. ~~
AN ORDINANCE AMENDING SECTION 37-25(b), SECTION 37-25(C),
SECT ION 37-25 (d) , SECT ION 37-26 (a ) AND SECT ION 37-26 (c) ,
OF CHAPTER 37 OF THE CODE OF THE CITY OF FORT WORTH
(1964) , AS AMENDED, BY REVISING CERTAIN WASTEWATER RATES
AND CHARGES, WATER RATES AND CHARGES AND INSTALLATION
CHARGES; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDI-
NANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE
CODE OF THE CITY OF FORT WORTH IN CONFLICT HEREWITH; PRO-
VIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1 .
That Section 37-25(b) of Chapter 37 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
"(b) The following schedule of rates per month, or frac-
tion thereof, shall be the charges to all persons, as
herein defined, for furnishing water to water customers
located within the City:

The service charges set out in the foregoing schedule are
based upon the amount of water used as measured by
meters."
SECT ION 2 .
That Section 37-25(c) of Chapter 37 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:

"(c) The following schedule of rates per month, or
fraction thereof, shall be the basis for determining
charges to all customers for rendering sanitary sewerage
service, where the sewage produced by such customer is a
normal strength wastewater (two hundred ten (210) mg/1
B.O.D. and two hundred forty (240) mg/1 suspended solids)
and where such customer is located within the City:
"RATES FOR SEWERAGE SERVICE ONLY
"(1) A monthly service charge shall be charged
to all customers in the amount of four dollars
and thirty cents ($4.30).
"(2) A monthly volume charge shall also be
charged to all customers in the amount of six
hundred thirty-nine thousandths of a dollar
($0.639) per one hundred (100) cubic feet of
water used, or wastewater produced, as more spe-
cifically set forth hereinafter.
"The monthly volume charges for residential class
customers will be based on the individual customer's
average monthly water use during the preceding winter
quarter months of December, January and February. The
volumes used to compute these charges are based on the
amount of water used by the residential class customer as
measured by a meter. Where no preceding winter quarter
average is available from records, the Director shall
estimate a volume to be used for this monthly volume
charge.
"The monthly charges to commercial and industrial
class customers will be based on total water use as
measured by appropriate meters, with the provision that,
if a customer can show to the satisfaction of the Director
of the Waterworks Department that a significant portion of
the metered water usage does not enter the sanitary
sewers, the customer will be charged for only that volume
entering the sewers, as determined by a method approved by
the Director."
SECT ION 3 .
That Section 37-25(d) of Chapter 37 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:

"(d) The Director of the Waterworks Department shall
establish a monitored group class, consisting of those
customers whose wastewater strength is, in his judgment,
abnormally high or whose wastewater contains limited sub-
stances or materials, and charges to customers in this
class shall be computed in accord with the following
five-part rate schedule:

"The monitoring charge shall consist of all cost for
personnel, material and equipment used to collect and
analyze samples from the customer wastewater to determine
the strength of the wastewater produced and, when appro-
priate, to inspect pretreatment facilities, to administer
pretreatment permit systems and to enforce ordinance
requirements. Pretreatment requirements primarily affect
industries which discharge toxic substances into the
sewerage system.
"This schedule shall replace all other charges pre -
viously made for industrial waste strength."
SECTION 4 .
That "Schedule A" of Section 37-26(a), Connection Charge, of
Chapter 37 of the Fort Worth City Code (1964), as amended, be and
the same is hereby amended, and, after having been so amended,
"Schedule A" shall hereafter read and be as follows:
"The minimum monthly charge shall be equal to and be
the same as the monthly service charge as contained in
Section 37-25(b) hereof.

That "Schedule B" of Section 37-26(a), Connection Charge, of
Chapter 37 of the Fort Worth City Code (1964), as amended, be and
the same is hereby amended, and, after having been so amended,
"Schedule B" shall hereafter read and be as follows:
"The minimum monthly charge shall be equal to and be
the same as the monthly service charge."
SECTION 6.
That Section 37-26(c) of Chapter 37 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
"(c) A charge shall be made by the City water depart-
ment for each tap made to a water main for a connection,
which charge shall be determined by the size of the con-
nection and the character of the surface of the street in
which the connection is to be located. From the following
schedule shall be determined the charge for making taps,
and the charge shall be payable in advance:

For each 3/4-inch branch, add. $85.00

"Any water connection larger than two (2) inches
shall be made under contract between the customer and the
City. Total material and installation costs of the tap and
meter or meters, including multiple meter settings instead
of a three-inch or larger meter setting, shall be paid by
the customer. Payment shall be based on the cost estimated
by the Water Department, acting by and through the
Director of the Water Department. Developers will pay the
full cost of all water service taps constructed by con-
tract in new developments. All water meters connected
directly to the City's water system on and after the
effective date hereof shall be the property of the City.
"When requested to do so, City forces may install
building sanitary sewer taps and sewer service laterals
which are intended for connection to the City sanitary
sewer system, and the requesting party shall be required
to pay a fee for such installation according to the sched-
ule provided below. Fees are based on the size of the con-
nection and the character of the surface of the street in
which the connection is located and shall be payable when
application for installation is made. The fees are as fol-
lows:

"In the case where sewer taps and sewer service
laterals are not installed by City forces, application
shall be made to the Water Department for authorization of
installation by private concerns. Pre-installation plans

must be approved by the Water Department. Such approval
shall include approval of any contractors who intend to
perform the installations. The Water Department shall pro-
vide the applicant with a written description or sketch
showing the approximate location of the sanitary sewer
serving the property. All installations must be approved
by the Water Department before connection to the sanitary
sewer system is made.
"The City maintains in part of the downtown area a
separate sanitary sewer system to serve the basements of
the buildings located in that area. The separate system is
referred to as the deep sewer. The construction of the
sewer tap and/or the sewer service lateral shall be done
by the City forces; provided that, where the sewer service
lateral can be constructed without cutting the surface of
the public street, the plumber or person holding the
permit may be permitted by the plumbing inspector to con-
struct the sewer service lateral in accordance with
requirements of the Fort Worth Plumbing Code and all other
applicable ordinances of the City, subject to the approval
of the plumbing inspector. Any work done by City forces in
making a deep sewer connection shall be paid for by the
plumber or other person holding a plumbing permit relating
to such deep sewer connection..
"The above charges shall be in addition to the appli-
cable fee or fees provided for in the Fort Worth Plumbing
Code. No plumbing permit for work which involves the con-
struction of the sewer tap and/or sewer service lateral
shall be issued until the charges have been paid and
receipt evidencing such payment is presented to the person
issuing the plumbing permit."
SECTION 7 .
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1964},
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.

SECT ION 8 .
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 9 .
All rights and remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of Chapter 37 or of any
amendments thereto of the Code of the City of Fort Worth ( 1964) , as
amended, which have accrued at the time of the effective date of
this ordinance; and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or
not, under such ordinances, same shall not be affected by this ordi-
nance but may be prosecuted until final disposition by the courts.
SECTION 10 .
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption in the
minutes of the City Council and by filing the ordinance in the ordi-
nance records of the City.

SECTION 1 1 .
That this ordinance shall become effective and be in full force
and effect from and after its passage, provided, however, that the
increased rates specified herein shall apply to customer utility
statements sent by the City of Fort Worth on or after October 1,
1986, and it is so ordained.

Recommendation•
It is recommended that the City Council.
1. Repeal Ordinance No. 9675, and,
2. Approve the attached Ordinance, adopting revised water, wastewater and
water and sewer tap fee rate schedules to be charged all retail customers
of the Fort Worth Water Department with an effective billing date on and
after October 1, 1986.
Back round•
~n -Tuned, 1986 (M&C G-6737) the City Council approved Ordinance No. 9675
which adopted new water, wastewater, and water and sewer tap fee rate
schedules. However, in reviewing the final adopted ordinance, it has been
discovered that one tap fee was in error and another fee was left out
entirely. The revised fees are as follows:

In addition, since June 15, 1986, a subsequent cost analysis of 3/4" and 1"
water branches was performed by Water Department staff. The analysis indicated
that current branch fees are set at a rate considerably less than the actual
cost. The following changes in branch fees are therefore recommended:
