HomeMy WebLinkAboutOrdinance 9597 ORDINANCE NO. `~_ AN ORDINANCE APPROPRIATING $1,454,910 FROM AIRPORT FUND 40 TO NONDEPARTMENTAL AIRPORT FUND ACCOUNT 55-40-00: AND TRANSFERRING SAID SUM OF $1,454,910 FROM NONDEPARTMENTAL AIRPORT FUND ACCOUNT 55-40-00, TO GRANT FUND 76, PROJECT ACCOUNT N0. 21866500, SOUTH FORT WORTH AIRPORT, IN ORDER TO MEET THE CITY'S ESTIMATED FAA MATCHING GRANT PORTION FOR PHASE I AND PORTIONS OF PHASE II AND PHASE III AIRPORT IMPROVEMENT; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING, AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT $1,454,910 is hereby appropriated from Airport Fund 40, fund balance unrestricted, to Nondepartmental Airport Fund Account 55-40-00, and the said sum of $1,454,910 is transferred from Nonde- partmental Airport Fund Account 55-40-00 to Grant Fund 76, Project Account No. 21866500, South Fort Worth Airport, in order to meet the City's estimated FAA matching grant portion for Phase I and portions of Phase II and Phase III Airport Improvement. SECTION 2. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections 1 and 5 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. These funds were designated to be used for matching funds as FAA grants became available. Additionally, the City Manager was authorized to apply, accept, and execute the grants when offered. Since the development of the above cost estimates, much progress has been made on the airport project. When the passage of time, land costs have steadily increased. To date, the City has received from the U. S. Department of Transpor- tation, Federal Aviation Administration eight separate Federal Grant Agreements totaling $16,369,475. The City°s grant matching funds have totalled $1,818,833. Additionally, $1,958,000 of the City's fund have been used for the project to acquire a portion of Oak Grove Airport and the right to close the Oak Grove Air- port runway,. t,o acquire right-of-way for Stone Road (a thoroughfare adjacent to the South Fort Worth Airport), and to acquire other parcels ofi land in advance of a grant offer to facilitate construction scheduling. Of the $1,958,000 spent by the City, approximately $145,000 is eligible for grant reimbursement. The FAA has recently issued a Grant offer of $2,500,000 that requires City response with matching funds. Considerably more funds will be needed, as outlined in Informal Report No. 7101, to complete the Phase I and partial Phase II and Iii improve- ments on the airport. It is now estimated that an additional $1,454,910 will be needed as the City's matching portion, with FAA providing an additional $11,133,976 in federal grants.
