AN ORDINANCE DECREASING THE UNDESIGNATED FUND BALANCE OF
THE GENERAL FUND, FUND BALANCE, OF THE CITY OF FORT WORTH
FOR FISCAL YEAR 1985-1986 by $500,000® AND APPROPRIATING
SAME TO GENERAL FUND ACCOUNT 90-97-00, DELINQUENT TAX
COLLECTIONS, FOR THE PAYMENT OF ATTORNEY`S FEES ARISING
OUT OF CITY SECRETARY CONTRACT NO. 14194, FOR THE
ANTICIPATED COLLECTION OF' DELINQUENT TAXES AND DELINQUENT
PAVING, WEED AND DEMOLITION ASSESSMENTS; PROVIDING FOR A
SEVERABILiT Y CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT ; AND PROVIDING AN EFFECTIVE DATE .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECT ION 1 .
That the Undesignated General Fund balance of the General Fund,
Fund Balance, of the City of Fort Worth for Fiscal Year 1985-1986 is
hereby decreased by appropriating $500,000 to General Fund Account
90-97-00, Delinquent Tax Collections, for the payment of attorney's
fees arising out of City Secretary Contract No. 14194 for the
anticipated collection of delinquent taxes and delinquent paving,
weed and demolition assessments.
SECTION 2 .
This Ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1964), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.

SECT ION 3.

It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
effective date in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 5
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

RECOMMENDATION
It is_-recommended that the City Council adopt the attached supplemental appropri-
ation ord Hance appropriating $500,000 from the General Fund, Fund Balance, to
General.__Fund Account 90-97-00, delinquent Tax Collections (3?_9813), for payment
~of collection on delinquent tax, paving, weed and demolition cases.
. __BACKGROUND
In __1.9.84,_._the City contracted with the firm of Heard, Goggan and Biair (HGB) for
enforcement of collection of delinquent taxes, paving, weed and demolition
accounts, including penalty and interest. The 15 percent attorney's fees for
this service are collected from the taxpayer (except in cases prior to 1984).
The City then pays the attorneys directly and is reimbursed proportionately from
the School District (FWISD).
For fiscal year 1985-86, $350,000 was budgeted for payment of delinquent tax col-
lection attorneys' fees. Payments made to HGB during the period October 1985
through 'May 1986 totalled
City Tax Collection payments = $223,59 3.43*
City Paving Collection payments = 125,25.2.26
TOTAL 348,845.69
As of Play 30, 1986, delinquent collections (adjusted for HGB payments) totalled•
Delinquent Tax Collections = 1,746,326.57*
Delinquent Paving Collections = 455,748,46
TOTAL 2,202,075.03
(*Payments to HGB for 1983 and prior accounts are paid directly by the City of
settled without suit per State statute).
During the current year, 3,818 suits have been filed and 4,136 accounts have been
settled (with and without suit).
Current year (1985) delinquent accounts are being turned over to HGB in July,
1986, and will significantly increase deliquent collections totals. In addition,
paving, weed and demolition collection are being pursued for the first time this
year through HGB which will increase collections and payments to HGB.
Staff projects an additional $2,300,000 in tax and $1,000,000 in paving collec-
tions through HGB, resulting in $500,000 in payment pass-throughs. In order to
reimburse the attorneys from collections expected, a supplemental appropriation
of $500,000 is required. APPROVED
