AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE McALISTER ROAD IMPROVEMENTS PROJECT OF THE TRANSPORTATION
IMPACT FUND BY$240,000.00 FOR THE PURPOSE OF DESIGN AND CONSTRUCTION
OF McALISTER ROAD AND DECREASING FUND BALANCE IN THE UNSPECIFIED
SERVICE AREA Z OF THE TRANSPORTATION IMPACT FEE FUND BY THE SAME
AMOUNT; ESTABLISHING A LEGAL LEVEL OF CONTROL; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of
the City Manager,there shall also be increased estimated appropriations in the McAlister Road Improvements Project
of the Transportation Impact Fund in the amount of$240,000.00 for purpose of design and construction of McAlister
Road and decreased fund balance in the Unspecified Service Area Z of the Transportation Impact Fund by the same
amount.
SECTION 2.
That, except as otherwise provided,in this section,the legal level of control shall be at the Project level, for which an
appropriation is adopted herein. The Chief Financial Officer acting on behalf of the City Manager may,in consultation
with a department head, approve the allocation of funds to a lower level(subproject)within the same Project without
the approval of the City Council so long as such reallocation otherwise complies with all applicable laws and
ordinances and does not result in a net increase to the Project's overall appropriation.
SECTION 3.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any
reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining
portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full
force and effect.
SECTION 4.
That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with such
other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and
appropriations are hereby expressly repealed.
SECTION 5.
This ordinance shall take effect upon adoption.

Authorize Reimbursement of Roadway Design and Construction Costs to the City of Burleson in the
Amount of$240,000.00 for its Construction of a Portion of McAlister Road Within the Limits of the City of
Fort Worth and Adopt Appropriation Ordinance (COUNCIL DISTRICT 6)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
McAlister Road Improvements Project of the Transportation Impact Fund in the amount of$240,000.00
from available funds and reduce the fund balance in the Unspecified Center, Service Area Z, of the fund
by the same amount; and
2. Authorize a reimbursement payment to the City of Burleson totaling $240,000.00 for the costs of design
and construction of a portion of McAlister Road within the limits of the City of Fort Worth.
DISCUSSION:
On May 5th, 2009, the City Council approved Mayor and Council Communication (M&C) C-23500
authorizing the City Manager to execute an Inter-local Agreement (ILA) with the City of Burleson to
participate in the cost of design and construction of McAlister Road from the southbound Interstate 35W
frontage road to just west of the Union Pacific Railroad (UPRR) crossing. As required in the approved
2009 ILA, the City of Burleson paid $240,000.00 for the project to the City of Fort Worth. This McAlister
Road improvement was constructed under a City of Fort Worth contract with McClendon Construction
(M&C C-24844, Contract 41730) and was completed in 2013.
The portion of McAlister Road west of the UPRR crossing is fully within the limits of the City of
Burleson. In late 2014, a multifamily development called the Reserve at McAlister was approved and
permitted by the City of Fort Worth just north of McAlister Road and west of the UPRR. The required
second point of access for this development was shown to be from McAlister Road but permitting for
construction of that access drive was within the jurisdiction of the City of Burleson. After several
discussions involving Staff from the City of Fort Worth and the City of Burleson, Staff from the
Transportation and Public Works Department negotiated a resolution with the City of Burleson's Director of
Engineering to permit an access drive from the Reserve at McAlister multifamily development to the City
of Burleson's section of McAlister Road. As a part of this solution, Transportation and Public Work's staff
support refunding the $240,000.00 the City of Burleson had paid towards the design of McAlister Road
east of the UPRR track. This will allow the City of Burleson to mitigate the traffic impact of the multifamily
development on the Burleson section of McAlister Road with a future project to extend the existing median
to create a "right-in, right-out only" for the new drive constructed as the second point of access for the
Reserve at McAlister Project.

The section of McAlister Road for which the City of Burleson funded the design in the amount of
$240,000.00 is identified as an eligible roadway within the Transportation Improvements Plan of the 2013
Transportation Impact Fee Study. As such, Fort Worth will repay the City of Burleson $240,000.00 from
the available Transportation Impact Fee Funds. McAlister Road is located in Transportation Impact Fee
Service Area Z and in COUNCIL DISTRICT 6.
This contract will be with a governmental entity, state agency or public institution of higher education: City
of Burleson.
FISCAL INFORMATION / CERTIFICATION:
The Finance Director certifies that upon the approval of the above recommendations and the adoption of
the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated,
of the Transportation Impact Fund.
