SAMUEL SURVEY, ABSTRACT NO. 824 AND FACTORY PLACE ADDITION,IN THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BEING APPROXIIVIATELY 50 FEET WIDE BY 300 FEET LONG, CONTAINING APPROXIMATELY 0.402 ACRE OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVH)ING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Lisbon Street right of way located in the I. Samuel Survey, Abstract No. 824, in the City of Fort Worth, Tarrant County, Texas, being that portion of said street bound on the east by Hopkins Street, on the south by Lot 1-A-Rl, Block 7, Factory Place, as recorded in Cabinet A, Slide 5597, on the west by Lot 1-R-A, Block 18, Factory Place Addition, as recorded in Cabinet B, Slide 1651, Lot 4-A2, Block 7 Factory Place Addition as recorded in Cabinet A, Slide 3244 and on the north by lots 5-10, Block 18, Factory Place Addition, as recorded in Volume 204A, Page 100, all of the Plat Records of Tarrant County, Texas, being 50 feet wide by 300 feet long, containing 0.402 acre of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. Ordinance No.17984-02-2008 SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. No. 17984-02-2008 DATE: Tuesday, February 12, 2008 LOG NAME: 06VA-06-033 REFERENCE NO.: PZ-2773 SUBJECT: Adopt an Ordinance Vacating a 0.402 Acre Portion of Lisbon Street between Hopkins Street and Hulen Street in the Factory Place Addition, City of Fort Worth, and Waive Purchase Fees RECOMMENDATION: It is recommended that the City Council: 1. Adopt an ordinance vacating a portion of Lisbon Street right-of-way between Hopkins Street and Hulen Street, being approximately 50 feet wide by 300 feet long consisting of 0.402 acres of land, in Block 7 and Block 18, Factory Place Addition, an addition to the City of Fort Worth, as filed in Cabinet A, Slide 5597, and Cabinet B, Slide 1651, Plat Records, Tarrant County, Texas; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624). DISCUSSION: Innovative Developers, Inc., on behalf of Healthpoint, Ltd., has requested to vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property. The City Plan Commission recommended approval of this request at its meeting on November 17, 2006. An acceptable replat (FS-07- 137) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived. This request is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
