HomeMy WebLinkAboutOrdinance 9302.,fin R vL ti r.~ ~~R Y ORDINANCE NO. ~--~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A 10 FOOT BY 289 FOOT EAST/WEST UTILITY EASEMENT LOCATED IN BLOCK A, RIDGLEA SOUTH ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 10 foot by 289 foot east/west utility easement located in Block A, Ridglea South Addition, said easement being more partic- ularly described by metes and bounds in Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned, and permanently closed and extinguished as a public utility easement. SECTION 2. That the fee to the land in the above described vacated public utility easement is hereby released and shall revert to the adjacent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. V-84-8b MiN1Sl'RATllil:d dl David White, surveyor, on behalf of the Independent Order of Foresters (IOF), with the written consent of all abutting owners, has requested that the City vacate a 1.0' x 289' east/west utility easement located within dock A., Rfdglea South addition. ' 'T4~e subject utility easement, acquired by dedication, is platted and contains a sanitary sewer line. ~e subject vacation rer.Ruest is made in order to replat the vacated easement right-of-sway with ~i~acent property, thus expanding the buildirx~ area and providing more usable yard space. It is the opinion of the Fdeal Property Department that the rights and interest of the City in the subject utility easement have been properly served, i~ a new easement is dedicated in a location collinear with the relocated sanitary sewer facility. ~erefore, there is no oognpensatian required. Iieviewinq City departments and private utility oompanies have raised no obaec- tions, subject to an acceptable replacement easesr~-nt k~eitx~ provided on a re- plat, as Hated above. A satisfactory replat has been submitted. Reca~enendation Tt is recommended that the City Council adapt an ordinance vacating the 10' x 289' east/west utility >~asernent located within Block A, Ttidglea South Addition.
