Recommendation
It is recommended that the City Council adopt an ordinance vacating the northern
p.o:rtion of the 15' wide north/south alley in Block 6, Hillcrest Addition,
y~extending a district of 201.11` , adjacent to Lots 1-4, north portion of Lot 5,
Lots 17 & 18, and the north portion of Lot 16, as recommended by the City Plan
Commission.
Discussion
Landes & Associates, representing owners of all adjacent property, have requested
that the City vacate the northern portion of the north/south al 1 ey i n B1 ock 6,
Hillcrest Addition, adjacent to Lots 1-4, north portion of Lot 5, Lots 17, 18,
and the north portion of Lot 16, as shown on the attached map.
The subject alley right-of-way, acquired by dedication, is open on the ground and
contains sewer, gas, telephone, and electric utility facilities. The subject
vacation request is made in order to replat the vacated right-of-way with
adjoining property, thus expanding the building area and providing more usable
yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
In the case of the existing utility facilities, the responsible entities have
required that the appropriate easements be retained, Further, alternate access
to Western Avenue from the north end of the alley remainder, ar a standard
cut-de-sac, must be dedicated by the required plat.
Other than the aforementioned comments, reviewing City departments have raised no
objections to this request, subject to submission of a satisfactory replat. A
satisfactory replat has been submitted.
The City Plan Commission has reviewed this request, and recommends that the
subject portion of alley be vacated as requested.
