ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF BEACH STREET EXTENSION IN THE CITY OF FORT WORTH, TEXAS, FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND OWNERS OF RAILWAYS AND TO ALL OTHERS INTERESTED, AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that the hereinafter described portion of Beach Street Extension in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing thereon a 10 inch flexible base course, with a 32 inch Hot Mix Asphaltic Concrete Base on top of said flexible base and by surfacing same with a 11 inch Hot Mix Asphaltic Concrete Surface, and by constructing combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all which said improve- ments shall be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor, and contract therefor has been made and entered-. into with Texas Bitulithic Company; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements, estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and amounts to be assessed against railways for improvements in the area between and under rails, tracks, double tracks, turnouts and switches, and two feet on each side thereof, and such estimates have been examined, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby, adopted and approved. II. It is hereby found and determined that the cost of improvements on the hereinafter described portion of Beach Street Extension, with the amount or amounts per front foot proposed to be assessed for such improvements against the abutting property and the owners thereof and the amount to be assessed against railways for improvements in the area between and under rails, tracks, double tracks, turnouts and switches and two feet on each side thereof, are as follows, to wit: On BEACH STREET EXTENSION: from the southeasterly line of Belknap Street to the southerly line of Galvez Avenue, known and designated as Unit No. 1: the estimated cost of the improvements is $ ; the estimated amount per front foot to be assessed againE abutting property and the owners thereof for curb and gutter is $ G$ ; the estimated amount per front foot to be assessed against abutting property - 1 - and the owners thereof for improvements exclusive of curb and gutter is $� ; total estimated amount per front foot to be assessed againsT abutting property and the owners thereof is $9.63 ; the estimated amount to be assessed against any railway, street railway or interurban, its roadbed, ties, rails, fixtures, rights and franchises, using, occupying and/or crossing said portion of Beach Street Extension, for improve- ments in the area between and under rails, tracks, double tracks, turnouts and switches and two feet on each side thereof, is the estimated cost of the improvements in such area, which is II. A hearing b9given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portion of Beach Street Extension and to all others owning or claiming any interest in any such property and to the owners of railways, street railways and interurbans, using, occupying and/or crossing said portion of Beach Street Extension and to all others owning or claiming any interest in any suc4 property. D. , 1956, at 'cloc , :F- M., n e Council Chamber n e City Hall in e ty of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106 of the Acts of said Session, now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten (10) days before the date of said hearing and said notice shall comply with and be in accordance with the terms and provisions of said Act.
