Bertram Construction & Engineerin~OR THE CONSTRUCTION Ol' SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDa DIRECTING THE ISSUANCE, EI~CUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOAfE OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE EOOY~ OF THE CITX COUNCIL OF FORT WORTEI, TE7CAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITYa AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, -tram Construction & Engineering., improvements on the hereinafter in said Citya tomiaita VILLAGE CREEK ROAD Texas, has $eretofore entered into a contract Cnc. , for the malting and construction of 'escribed portions of streets, avenues and From Richardson to Ramey, known and designated as Project No. 013=-022-1_i2-00, a seven-inch thick reinforced concretE~ pavement with seven- inch high superimposed concrete curb on a six- inch thick. lime stabilized subgrade, so that the finished roadway wil]_ be thirty-six feet wide. Six=inch thick concrete driveway approaches and turn lanes will be constructed where specified. Four foo~C wide concrete sidewalk will be construc- ted adjacent to -all developed property. tivHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No, 9048 ~ a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, wHE~~:EAS, the City Council of the City of Fort ~~orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No, 9048 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NUtiu, '1`tIEFtL:FORE, FEE IN ORDAINED ~3Y THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXr1S, THAT I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance Frith the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective Credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if an4y, are hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payarent of the contract price. IV. The Cfty Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Te~cas, and by filing the complete ordinance in the appropriate Ordinance Records of said City, V.
