AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EX-
TINGUISHING A PORTION OF THE EMERGENCY ACCESS AND
UTILITY EASEMENT KNOWN AS HULEN TOWERS CIRCLE AND
LOCATED IN LOT 3, BLOCK 1, HULEN TOWERS ADDITION, AS
_ SHOWN ON PLAT RECORDED IN VOLUME 388-154, PAGE 86, PLAT
RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION
OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
` BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of the emergency access and utility easement
known as Hulen Towers Circle and located in Lot 3, Block 1, Hulen
Towers Addition, as shown on plat recorded in Volume 388-154,
Page 86, Plat Records, Tarrant County, Texas, said portion being
more particularly described in Exhibit "A", said Exhibit being
attached hereto and incorporated herein, be and the same is
vacated, abandoned and permanently closed and extinguished as a
public emergency access and utility easement.
SECTION 2.
That the fee to the lands in the above described vacated pub-
lic emergency access and utility easement is hereby released and
shall revert to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

PROPERTY DESCRIPTION
For Portion of Hulen Circle to be Vacated
0.227 of an acre of land being a portion of Hulen Towers Circle
(private street and. a 26 foot wide emergency access and utility
easement) as situated in Lot 3, Block 1, Hulen Towers Addition
to the City of Fort Worth according to the plat recorded in
Volume 388-154, Page 86, Tarrant County Plat Records. Said
0.227 of an acre being more particularly described by metes and
bounds as follows:
COMMENCING at the northeast corner of said Lot 3;
THENCE S 89° 45' 00" W, 129.50 feet;
THENCE S 0° 18` 16" E, 17.00 feet to the POINT OF BEGINNING;
THENCE S 0° 18' 16" E, 95.00 feet;
THENCE S 89° 45' W, 26.00 feet;
THENCE N 0° 18' 16" W, 69.00 feet;
THENCE S 89° 45' W, 178.36 feet;
THENCE S 44° 54' 08" W, 14.18 feet;
THENCE S 0° 03' 15" W, 59.00 feet;

Recommendation
It is recommended that the City Council adopt an ordinance vacating the most
northerly 240.2' x 26' east/west portion of the emeryency access and utility
easement and the two most northerly 69' x 26' north/south sections of the same
emergency access and utility easement, located within the current boundaries of
Lot 3, Block 1, Hulen Towers Addition.
Discussion
Landes & Associates, on behalf of Marlene Mallick, owner of all abutting
property, have requested that the City vacate the most northerly 240.2' x 26'
east/west portion of the emergency access and utility easement and the two most
northerly 69' x 26' north/south sections of the same emergency access and utility
easement,. located within the current boundaries of Lot 3, Block 1, Hulen Towers
Addition, as recorded in Volume 388-154, Page 86, P.R.T.C.T., and as shown on the
attached map.
The subject emergency access and utility easement, acquired by dedication, is
platted and contains no water utility facilities. The subject vacation request
is made in order to utilize the vacated easement as part of the subject property,
thus expanding the building area and providing more usable yard space.
It is the opinion of the Real Property Department of the City that the rights and
interest of the City in the subject easements will be served with the dedication
of replacement easements in the required replat with the adjoining property.
Reviewing City departments and private utility companies have raised no
objections to this request. A satisfactory replat, which dedicates the required
relocation and extension of the 26' wide emergency access and utility easement
and the replacement easement for the existing water line, has been submitted.
