ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EX-
TINGUISHING THE 15-FOOT WIDE EAST/WEST UTILITY EASEMENT
LOCATED IN LOT 1, BLOCK "A", RALSTON PURINA SUBDIVISION;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the 15-foot wide east/west utility easement located in
Lot 1, Block "A", Ralston Purina Subdivision, said easement being
more particularly described in Exhibit "A", attached hereto and
incorporated herein, be and the same is vacated, abandoned and
permanently closed and extinguished as a public utility easement.
SECTION 2.
That the fee to the land in the above described vacated pub-
lic utility easement is hereby released and shall revert to the
adjacent owners as provided ,by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed .
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

LEGAL DESCRIPTION
BEING a fifteen {15.0') foot wide easement for a sanitary sewer
line owned by the City of Fort Worth, situated in Lot 1 of the
Ralston Purina Addition, Tarrant County, Texas as recorded i:~
Volume 388-110, Page 36, Plat Records of Tarrant County Texas, and
more particularly described by metes and bounds as follows:
COMMENCING at the most southwesterly corner of Lot 1 Ralston
Purina Subdivision and north R.O.W. line of East Fourth Street (a
varying R.O.W. width being a minimum of 80.0');
THENCE, N 29°33''0U" W, a distance of 145.0 feet to a point for

THENCE, N 65°09'00" E, a distance of 126.4 feet to a point for
corner, said point also being the POINT OF BEGINNING;
THENCE, N 3Q°09''00" W, a distance of 15.06 feet to a po.i~t for
corner;
THENCE, N 65°09'00" E, a distance of 330.18-feet to a point for
corner, said paint also lying on the east property line of a~.alston
Purina Addition;
THENCE, S 10°48'00" E, along said property line a distance of
0.09 feet to a point fo.c corner;
THENCE, 5 10°40'00" E, along said property line a distance of
15.38 feet to a point for corner;

325.11 feet to the POINT OF BEGINNING and containing 4,915 square

Recommendation
It is recommended that the City Council adopt an ordinance vacating the 325.11' x
15' east/west utility easement located in Lot 1, Block "A", Ralston Purina Sub-
division.
Discussion
Bill James, agent for Ralston Purina, owner of all abutting property, has
requested that the City vacate a 325.11' x 15' east/west utility easement located
Block "A", Ralston Purina Subdivision, as shown on the attached map.

The subject utility easement, acquired by dedication, is platted but contains no
utility facilities. The subject vacation request is made in order to utilize .the
vacated easement as part of the subject property, thus expanding the building
area and providing more usable yard space.
The necessary and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
Reviewing City departments and private utility companies have raised no objec-
tions to this request.
