AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EX- TINGUISHING THE 15-FOOT WIDE EAST/WEST UTILITY EASEMENT LOCATED IN LOT 1, BLOCK "A", RALSTON PURINA SUBDIVISION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 15-foot wide east/west utility easement located in Lot 1, Block "A", Ralston Purina Subdivision, said easement being more particularly described in Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished as a public utility easement. SECTION 2. That the fee to the land in the above described vacated pub- lic utility easement is hereby released and shall revert to the adjacent owners as provided ,by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed . SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Recommendation It is recommended that the City Council adopt an ordinance vacating the 325.11' x 15' east/west utility easement located in Lot 1, Block "A", Ralston Purina Sub- division. Discussion Bill James, agent for Ralston Purina, owner of all abutting property, has requested that the City vacate a 325.11' x 15' east/west utility easement located Block "A", Ralston Purina Subdivision, as shown on the attached map. in Lot 1 , The subject utility easement, acquired by dedication, is platted but contains no utility facilities. The subject vacation request is made in order to utilize .the vacated easement as part of the subject property, thus expanding the building area and providing more usable yard space. The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objec- tions to this request.
