AN ORDINANCE AMENDING CHAPTER 28, "PLANNING", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1964), AS AMENDED, BY AMENDING SECTION 28-01 THEREOF TO CHANGE THE FEES CHARGED FOR SPECIAL EXCEPTION APPLICATIONS BEFORE THE ZONING BOARD OF ADJUSTMENT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING FOR AN AFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS; SECTION 1.. That Chapter 28 of the Code of the City of Fort Worth, Texas {1964), as amended, is hereby further amended by revising the appli- cation fees for Zoning Board of Adjustment applications as set forth in Section 28-01(a), which fees shall be as follows: "Zoning Board of Adjustment: Variances For church site plans and owner-occupied residential property .......................$150.00 Commercial property .........................$200.00 Special Exceptions Auxiliary Parking Exceptions ................$125.00 Other Special Exceptions ....................$325.00 Interpretation by Board of Adjustment............$350.00" SECTION 2. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of -, .. ~' this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections 1 and 5 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. Background On October 15, 1985, the City Council adopted Ordinance No. 9500 requiring the erection of a sign on all properties on which a special exception use applica- tion has been filed with the Zoning Board of Adjustment. At that time, the City Council adopted a recommendation by the City Manager that an extra fee of $25.00 be charged for such special exception use applications in order to de- fray the cost of erecting the signs.
