ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF COLUMBUS TRAIL
AND PORTIONS OF SUNDRY OTHE~t STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TE7KASE DECLARING THE CONTRACT WITH
APAC-Texas, Inc. FOR THE CONSTRUCTION OF
SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDg DIRECTING THE
ISSUANCE, E1tECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE
BY COPYING THE CAPTION OF SAYE IN THE MINUTE BOOK OF THE CITY
COUNCIL OF FORT WORTH, TE7~CAS, AND BY FILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECO1tDS OF SAID CITYy AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
wrath APAC-Texas. Inc. a for the maleing and construction of
certain street improvements on the hereinafter described portions of streets, avenues and
public places in said City, to®~it:
COLUMBUS TRAIL From the West Property Line of Lot 48, Block 21, The Meadows
Addition, Phase TI, to the East Property Line of Lot 28, Block
19, The Meadows Addition, Phase II, Known and designated as
Project No. 21-036789-00, a seven-inch thick hot-mix asphaltic
concrete pavement with .seven-inch high concrete curb and eight-
een-inch wide concrete gutter on a six-inch thick lime stabiliz-
ed subgrade, so that the finished roadway will be forty-feet
wide.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 9225 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above. described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHER:EAS, the City Council of the City of Fort ~~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain cred~.ts against
some one or more of the assessments levied by Ordinance No, 9225 , and
WHENEA.~, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:

The improvement-s on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.

The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessmeritse The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereone The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if an4y, are hereby enumerated and itemized as follows:

When sects of the certificates hasp been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price,
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Baok of the City Council of Fort Worths Texans
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passages
