HomeMy WebLinkAboutOrdinance 9409,~ ORDINANCE NOo ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF CAMP BOWIE BOULEVARD AND PORTIONS OF SUNDRY OTHE#L STREETS, AVENUES AND PUBLIC PLACES IN TFIE CITY OE FORT WORTH, TEXAS9 DECLARING TEE CONTRACT WITH AUSTIN ROAD COMPANY FOR T1I~E CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDa DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTYFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS IiEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORIINANCE BY COP5CING THE CAPTION OF SAME IN THE MINUTE BOOR OF THE CITY COUNCIL OF FORT WORTHY TEXAS, AND BY FILING TIDE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITYg AND PROVIDING AN EFFEC°rlvE DATE, WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract wrath _ Austin Road Comnany , for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, tom~iito CAMP BOWIE BOULEVARD From Montgomery Street to 25 feet East of Belle Place, known and designated as Project No. 30-025259-00, Unit I, to be reconstructed with two and. one/fourth inch thick brick pavers with seven-inch high concrete curb and two- foot wide concrete gutter on a six-inch thick reinforced concrete base, so that the finished roadway will basic- ally consist of two twenty-six feet wide traffic lanes with a twenty-eight feet wide median with brick paver turn lanes and concrete median openings ad specified. Existing deteriorated concrete driveway approaches and curb and gutter will be reconstructed where required. __` \, ~vHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No, 9228 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues acid public places and against the real and true owners thereof; and, wHEfi1;A3, the City Council of the City of Fort ~~orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No, 9228 , and WHEfiEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in comglete accordance with the contract therefor; NOW, TfiEIiEFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT Io The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. IIe The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance Vrith the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thercone The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after diving effect to such credit, if arty, are hereby enumerated and itemized as follows: • ~: zII. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract pricee IV.
