AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF A PUBLIC STREET AND RIGHT-OF-WAY KNOWN AS HARDGROVE LANE, ALSO KNOWN AS COUNTY ROAD NO. 1064 LYING IN THE S. GRAY SURVEY, A-558, AND THE ABNER LEE SURVEY MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; EXCEPT FOR ANY EXIST- ING AND PROSPECTIVE UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of the street and right-of-way known as Hardgrove Lane and also known as County Road No. 1064 and more specifically described in Exhibit "A" attached hereto and incorpo- rated herein be and the same is hereby vacated, abandoned and permanently closed and extinguished as a public street and right- of-way. SECTION 2. That the fee to the lands in the above described vacated public street and right-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT any and all existing and prospective utility easements, which are hereby re- tained. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. A PROVED AS TO FO ND LEGALITY: City Attorney Date: ~9J~~--g~ _~ ADOPTED: EFFECTIVE: ~p~ p~ PROPERTY DESCRIPTION FOR A PORTION OF HARDGROVE ROAD (COUNTY ROAD NO 1064) TO BE ABANDONED A tract of land out of the Sarah Gray Survey, Abstract No. 558 and the Abner Lee Survey, Abstract No. 931, Tarrant County, Texas, and being a portion of the existing right-of-way of l-lardgrove Read (County Road No. 1064) and being more particularly described as follows: BEGINNING at a point in the north right-of-way line of said road, said point being N 89 50' W a distance of 675.4 feet from the east line of said Gray Survey; THENCE S 890 50' E along said right-of-way a distance of 2350.5 feet to a point; THENCE S 4° 13` 17" W a distance of 50.17 feet to a point in the south right-of-way line of said Hardgrove Road, THENCE N 89° 50' W along said right-of-way a distance of 2346.96 feet to a point, THENCE N 0° 10` E a distance of 50.0 feet to the POINT OF BEGINNING and containing 2.696 acres of land. S. Gray Survey, A-558; Cunniff Addition, Block 1, Lot 1, and Tracts 4A, 4B, 4G, 4F, 4F1, 4G and 4C, Abner Lee Survey as a public street and right-of-way, as recommended by the Plan Commis- sion. Discussion Mr. Mike Pyles, Manager of the Real Property Department, City of Fort Worth, has requested that the City vacate Hardgrove Lane (C.R. #1064) from C.R. #1004, west- ward 3330' adjacent to Tracts 2, 2B, 5D, 6D, 6E, 6C, 6B, A & 6, S. Gray Survey, A-558, Cunniff Addition, Block 1, Lot 1, and Tracts 4A, 4B, 4G, 4F•, 4F1, 4G and 4C, Abner Lee Survey, as shown on the attached map, The subject street right-of-way, acquired by dedication as a county road, is open on the ground and paved, and contains natural gas and telephone utility facili- ties. The subject street vacation has been requested in order to realign various streets within the general area where property is being acquired for the new South Tarrant County Airport. It has been noted that any monetary consideration related to the vacation of the previously described public riyht-of-way will be compensated by the realignment of the subject roadway at a different location. Reviewing City departments and private utility companies have raised no objec- tions to this request, subject to retention of necessary utility easements, retention of the existing roadway for public use until satisfactory partial cir- cumferential roadways are provided and constructed around the proposed airport, and physical closure with standard curb and gutter wherever such physical closure is required.
