ORDINANCE N0. ~ !~
AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISH-
ING SEVEN 10' X 10' TRANSFORMER PAD EASEMENTS AND ONE
RESTRICTED OPEN SPACE EASEMENT LOCATED IN VARIOUS LOTS IN
BLOCK 1, WESTOVER SQUARE ADDITION TO THE CITY OF FORT
WORTH; PROVIDING FOR REVERSION OF FEE IN SAID LANDS EXCEPT
FOR ANY EXISTING AND PROSPECTIVE UTILITY EASEMENTS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That each of the seven 10' X 10' transformer pad easements and
the restricted open space easement, more specifically described in
Exhibit "A" attached hereto and incorporated herein for all pur-
poses, be and the same are hereby vacated, abandoned and permanently
closed and extinguished as public easements.
SECTION 2.
That the fee to the lands in the above described vacated public
easements is hereby released and shall revert to the adjacent owners
as provided by law, SAVE AND EXCEPT any and all existing and pro-
spective utility easements, which are hereby retained.
SECTION 3. ..

That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in f ull force and
effect from and after the date of its passage, and it is so or-
dained.

Recommendation
It is recommended. that the City Council adopt an ordinance vacating seven 10'x10'
transformer pad utility easements and one restricted open space easement, located
within Westover Square Addition, Block 1, adjacent to and along Westover Square
(a private street), as recommended by the City Plan Commission.
Discussion
Carter & Burgess, Inc., on behalf of Robert M. Bass, et al, has requested that
the City vacate seven 10'x10' transformer pad Utility easements and one
restricted open space easement, all located within Westover Square Addition,
Block 1, adjacent and along Westover Square (a private street), as shown on the
attached map. The subject utility easements and open space easement, acquired by
dedication, are open on the ground and, except in some instances, contain no uti-
lities or other improvements. The purpose of this vacation request is to permit
relocation of certain existing utilities relative to a revised development plan.
Vacation of the subject easements will also permit rearrangement of the building
area and provide more usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
In the case of the existing utility facilities, responsible entities have re-
quired that appropriate easements be dedicated. Other than the aforementioned
comments, reviewing City departments have raised no objections to this request
,
subject to submission of a satisfactory replat. A satisfactory replat has been
submitted.
