HomeMy WebLinkAboutOrdinance 9513ORDINANCE NO. ~~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF THE UTILITY EASEMENT MORE SPECIF- ICALLY DESCRIBED HEREIN LYING IN, ON, OVER AND ACROSS LOT 1-R, BLOCK 2, OF THE WOODMONT ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That all that certain tract or parcel of land described more specifically in Exhibit "A" attached hereto and incorporated herein by reference in its entirety, comprising a portion of a utility easement lying~in, on, over and across Lot 1-R, Block 2, of the Woodmont Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from, and after the date of its passage, and it is so or- dained. DISCUSSION Phillip Norwood, President, and on behalf of Alta Mesa National Bank, owners of abutting property, have requested that the City vacate the above-described utility easement, as shown on the attached map.. The subject easement, acquired by dedication, is platted and contains telephone, electric and cable TV utility facilities. The subject vacation request is made in order to utilize the vacated easement to expand the building area and provide more usable yard space within the subject property. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City Departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted.
