ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING A 50' EASEMENT IN THE J, SPILLMAN SURVEY, A-1377,
TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN
SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH
AND PROVIDING AN EFFECTIVE .DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE 50' sanitary sewer easement in the J. Spillman Survey,
A-1377, Tarrant County, Texas, owned and controlled by the City of
Fort Worth and described more particularly in Exhibit "A" attached
hereto and incorporated herein in its entirety, be and the same is
heareby vacated, abandoned, and permanently closed and extinguished
as the 50' easement described herein.
SECTION 2.
That the fee to the land in the above described vacated 50'
easement is hereby released and shall revert to the adjacent owner
as provided by law.
SECTION 3..
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

BEING a portion of an existing sanitary sewer easement as recorded in Volume 6772,
Page 458, Deed Records, Tarrant County, Texas, in the James Spillman Survey, Abstract
No 1377, out of a tract of land conveyed to Haydn Cutler, Trustee, in Volume 7888,
Page 1923, said Deed Records and being more particularly described by metes and
bounds as follows
COMMENCING at a 3/4" iron rod on the east side of a stone for the northeast corner of
the J Spillman Survey, Abstract No. 1377 and said tract, the northwest corner of the
J Watson Survey, Abstract No 1666 and being in the south line of the J. Rogers
Survey, Abstract No. 1264, Tarrant County, Texas;
THENCE South 89° - 37' - 30" West along the common survey line of the aforementioned
J. Spillman Survey and the J Rogers Survey, a distance of 472.50 feet;
THENCE South 00° - 22' - 30" East a distance of 115 0 feet to the POINT OF BEGINNING;
THENCE South 00° - 22' - 30" East a distance of 50 0 feet;
THENCE South 89° - 37' - 30" West a distance of 232 07 feet to a point, said point
being the beginning of a curve to the left whose radius is 89.02 feet;
THENCE along said curve to the left a distance of 92.24 feet;
THENCE South 30° - 15' - 00" West a distance of 75 0 feet to a point, said point
being in a curve to the left whose radius is 676.29 feet;
THENCE along said curve to the left a distance of 202 50 feet to a point, said point
being in a curve to the left whose radius is 1563.13 feet;
THENCE along said curve to the left and also being the east right-of-way line of
Bellaire Drive South, a distance of 51 22 feet to a point, said point being the
beginning of a curve to the right whose radius is 726 29 feet;
THENCE along said curve to the right a distance of 177.11 feet;
THENCE North 30° - 15' - 00" East a distance of 25.0 feet to the beginning of a curve
to the right whose radius is 139.02 feet;
THENCE along said curve a distance of 144.06 feet;

Recommendation
It is recommended that the City Council adopt an ordinance vacating a portion of
an existing 50' wide utility (sanitary sewer) easement, as recorded in Voiu)ne
6772, Page 458, D.R.T.C.T., in the James Spillman Survey, Abstract No. 1377, out
of a tract of land conveyed to Haydn Cutler, Trustee, in Volume 7888, Page 19?..3,
D.R.T.C.T.

The Haydn Cutler Company, owner of all abutting property, has requested that the
City vacate the existing 50' wide utility (sanitary sewer) easement as described
above, and as shown on the attached map.
The subject easement, acquired by deed, is recorded, but contains no util tv
facilities. The subject vacation request is made in order to utilize the vacated
easement as part of the subject property, thus expanding the building area and
providing more usable yard space.
The necessary and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
Reviewing City departments and private utility companies have raised no objec-
tions to this request.
