ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF EAST NINTH'~STREET
AND PORTIONS OF SUNDRY OTHE$ STREETS, AVENgYES AND PUBLIC PLACES ~.
IN THE CITY OF FORT WORTH, TEXASa DECLARING- THE CONTRACT WITH
WALT WILLIAMS CONSTRUCTION. INC. FOR THE CONSTRUCTION OF
SAID YMPROVEMENTS FULLY COMPLETED AND PERFORMED9 DIRECTING THE
ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDElYCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GIVYNG EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAYNST SOME OF SAID ASSESSMENTS;
DIRECTING THE CYTY SECRETARY TO ENGROSS AND ENROLL THYS ORDINANCE
BY COPYING THE CAPTYON OF SAME YN THE MYRpUTE BOOR OF THE CITY
COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECORDS OF SAID CITYg AND PROVYDYNG AN
EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contrAct
wrath Walt Williams Construction, Inc. , for the making and construction of
certain street improvements on the hereinafter described portions of streets, avenues and
public places in said City, tom~iit:
EAST NINTH STREET From Pecan Street - Eastward to the Burlington Northern
Railroad, known and designated as Project No. 29-024311-00,
a seven-inch thick reinforced concrete pavement with seven-
inch high attached concrete curb on a six-inch thick lime
stabilized subgrade, so that the finished roadway will be
forty feet wide. Six-inch thick concrete driveway approaches
will be constructed where specified.
tivHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 9311 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHEiiEAS, the City Council of the City of Fort ~~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 9311 , and
WHEtiEAa, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

I3E IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
T~:XAS, THAT
I.
The improvement-s on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and perfornned.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of-the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments, The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereone The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

III.
When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage.

Deviation from Bid Price
Final measured quantities at contract un it prices yield an earned total price
for this contract of $155,449.19 which is $8,475.47 (5.49%) over the bid price.
The overrun is the result of differences between quantities estimated for the
contract documents and quantities actually used to complete the work.
Financing
Final payment to be made from the Project No. 29-024311-00. A bond fund transfer
in the amount of $8,480.00 is necessary to .provide additional funds.
