ORDINANCE NO. ~~~
°AN ORDINANCE SPECIFYING THE AUTHORIZED POSITIONS IN THE
POLICE DEPARTMENT AND CREATING NEW POSITIONS IN THE POLICE
DEPARTMENT; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; NAMING AN EFFECTIVE DATE;
PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDI-
NANCE.
WHEREAS, the Police Chief has requested the City Council to
specify and authorize the number of positions in the Police
Department for the 1984-1985 Fiscal Year; and
WHEREAS, with the passage of Ordinance 9168, the authorized
number of positions in the Police Department was established as 807,
with authorized staffing levels of 515 Police Officers, 153
Detectives, 8:9 Sergeants, 35 Lieutenants, 11 Captains and 4 Deputy
Chiefs; and
WHEREAS, the Police Chief desires to alter the authorized num-
ber of positions by adding 2 Police Officer Intoxylizer Operators,
without altering the budget of the Department; and
WHEREAS, the alteration of the authorized number of positions
will add two additional Police Officer positions;
WHEREAS, the specification and authorization of these positions
is a necessity; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the following positions are the only positions authorized
in the City of Fort Worth Police Department for the remainder of the
Fiscal Year 1984-1985:
Police Officers 517
Detectives 153
Sergeants 89
Lieutenants 35
Captains 11
Deputy Chiefs 4
TOTAL 809
SECTION 2.
That all of the declarations and findings contained in the
preamble of this ordinance are made a part hereof and shall be fully
effective as part of the ordained subject matter of this ordinance.

SECTION 3.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas ( 1 964) , as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 5.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the. caption and
effective date in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 6.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Background
Many administrative and programmatic changes will occur when the Police Depart-
ment successfully relocates into the new City/County Jail facility. One of the
changes anticipated durinv, the 1984-85 budget process was the DWI intoxilyzer
°breath test" function. Currently, the intoxilyzer test is administered by
civilians under the supervision of the officers within the secured area of the
3ai1 operations. In the new facility, the intoxilyzer operations will be
shared with the County and located in a separate building immediatey ad3acent
to the parking garage. The Iegal and operational lotsistics of using this in-
toxilyzer procedure have been adjusted to accommodate this problem of physical
proximity. During the City Council budget deliberations, four intoxilyzer
positions were discussed for the Police Department's operating budget. Of
these four positions, two were to be civilians a.nd two were to be civil service
police officers.
As the Wending move-in date for the Jail draws nearer, the department is pre-
paring for this revised intoxilyzer procedure. The two civilian positions have
already been. recruited. The Department requests the City Cou.ncil's approval to
increase the authorized civil service strength by the two ad~y~

Financing
Ftind.s are available in Account No. 35-54-00, Jail Division. Savings from the
two vacant civilian intoxilyzer positions and from the City/County prisoner
contract are sufficient to cover these expenditures. These two officer posi-
tions will cost approximately $17,100 for the remainder of the 1984-85 fiscal
year, assttmin+; the move will be completed in May.
Recommendation
It is recommend?d that the City Council increase the Police Department's
authorized civil service strength from 807 to 809 in or er to adequately staff
