ORDINANCE N0.
AN ORDINANCE APPROPRIATING ADDITIONAL REVENUE OF THE CITY
OF FORT WORTH IN THE AMOUNT OF $614,989.00 FROM THE FUND
BALANCE OF THE GENERAL FUND TO GENERAL FUND ACCOUNT N0.
90-15-00 AND TRANSFERRING SAID AMOUNT TO THE CITY INSURANCE
FUND, ACCOUNT N0. 14-20-00; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES
AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That the City Manager of the City of Fort Worth is hereby
authorized to appropriate $614,989.00 from the fund balance of
the General Fund to increase appropriations in General Fund
Account No. 90-15-00, Non-Departmental Self-Insurance Fund,
and to transfer said amount to the City Insurance Fund, Account
No. 14-2.0-00 ..
SECTION 2..
Should any portion, .section or part of a section of this
Ordinance be declared invalid, inoperative or void for any reason
by a court of competent juris.dic.tion, such decision, opinion or
judgment shall in no way impair the remaining portions, sections
or parts of sections of this Ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTTON 3.
That this Ordinance. shall be cumulative of Ordinance No. 9168,
and all other ordinances and appropriations amending the same except
in those instances where. the provisions of this Ordinance are in
direct conflict with such other ordinances and appropriations, in
which instances said conflicting provisions are hereby expressly
repealed.
SECTION 4.
That this Ordinance shall take effect and be in full force and
effect from and. after the date of its passage, and it is so or-
dained.

RECUh1P1ENDATION
It is recommended that the City Council
1) Adopt supplemental appropriation ordinances for both the General Fund
Account No. 90-15-00 and the City Insurance Fund Account No. 14-2U-UO in
the amount of $614,989. These increases in appropriations will come
from a decrease in the General Fund's fund balance and an increase in
the estimated receipts of the City Insurance Fund.
2) Authorize the transfer of $614,989 from the General Fund to the City
Insurance Fund, and
3) Approve the settlement of the claim of Louie Draper and wife, Martha
Draper, Individually and as Next Friend of their minor daughter, Kelly
Draper.
BACKGROU~dD
Louie Draper and Wife, Martha Draper, Individually and as next friend of their
minor daughter, Kelly Draper, have presented a claim for personal injuries
against the City of Fort Worth. The alleged personal injuries were sustained by
Kelly Draper on June 6, 1984, as the result of a motor vehicle accident between
a City sanitation truck and a motorcycle on which P1iss Uraper was a passenger.
The accident occurred at the intersection of Fairmont and Allen in Fort Worth,
4Jhile admitting no liability in this matter, the Risk Planagement Office and the
Department of Law have negotiated with claimants and have agreed to settle their
claim. The Risk P1anayement Office and the Department of Law have agreed to enter
into a structured settlement with the claimants. The cost to the City of the
structured settlement is $614,99. This settlement vrill be entered into in order
to avoid turther controversy and lengthy litigation.
FINANCING
Funds are available for this purpose in the General Fund's Fund Balance. These
funds sr~ould be transferred to the City Insurance Fund for expenditure purposes.
Supplemental appropriations will be required for both the General Fund (Fund O1)
and the City Insurance Fund (Fund 71). The General Fund's fund balance will be
approximately $ZU,000,OOO after this transfer. APPROVED BY
