ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF EDERVILLE RD. & MORRISON DR.
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUELIC PLACES
IN THE CITY OF FORT WORTHa TEXASy DECLARING TIC CONTRACT WITH
APAC-Texas, Inc._ FOR THE CONSTRUCTION OF
SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDg DIRECTING THE
ISSUANCES EXECUTION AAFD DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OI° SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE
BY COPYING TIC CAPTION OF SAME IN THE MINUTI 1$OOIC OF THE CITY
COUNCIL OF FORT WORTH, TEXAS, AND i$Y FILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECORDS OF SAYD CITY$ AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Fort Worths Texasa has heretofore entered into a contract
wrath APAC-Texas, Inc. , for the malting and construction of
certain street impro~rements on the hereinafter described portions of atreetsp avenues and
public places in said Citya tomwit:
EDERVILLE ROAD From Enoch Drive to Morrison Drive, known and designated as
Project No. 021-036577, Unit I, a seven-inch thick hot-mix
asphaltic concrete pavement with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a six-inch
thick lime stabilized subgrade, so that the finished roadway
will be forty-.four feet wide. Six-inch thick concrete drive-
way approaches will be constructed where specified.
MORRISON DRIVE From 263 feet south of Ederville Road to 590 feet north of
Ederville Road,. known and designated as Project No. 021-036577,
Unit II, a seven-inch thick hot-mix asphaltic concrete pavement
with seven-inch high concrete curb and eighteen-inch wide con-
crete gutter on a six.-inch thick lime stabilized subgrade, so
that the finished roadway will be forty feet wide. `Six-inch
thick concrete driveway approaches will be constructed where
specified .
1riHEI~AS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 8791 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues acid public places and against
the real and true owners thereof; and,
wHEt~AS, the City Council of the City of Fort ~~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 8791 , and
WHk:f~Aa, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance 4rith the contract therefor;
NOW, THEREFORE,
BE IN ORDAIIJED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT•
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed.
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments, The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and9ha11 be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worthy Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage.

Recommendation
It is recommended that the City Council.
(1) accept the assessment paving of Ederville Road (Enoch Drive to Morrison
Dr.) and Morrison Drive (263' south of Ederville Road to 590' north of
Ederville Road) by the adoption of an ordinance, and
(2) authorize final payment in the amount of $25,770.38 to APAC TEXAS, Inc.
