ORDINANCE N0. ~i~ ' ° AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF AN EXISTING UTILITY EASEMENT AS SUCH PORTION IS MORE SPECIFICALLY DESCRIBED HEREIN, LYING IN, ON, OVER AND ACROSS LOT 3, BLOCK A OF THE WOODMONT PLAZA ADDITION TO THE CITY OF FORT WORTH; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of an existing utility easement lying in, on, over and across Lot 3, Block A of the Woodmont Plaza Addition to the City of Fort Worth, Tarrant County, Texas, as such portion is more specifically described in Exhibit "A", attached hereto and incorpo- rated by reference herein for all purposes, be and the same is vacated, abandoned and permanently closed and extinguished as a utility easement. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Discussion P1r. Stephen Koslik, on behalf of Alta P1esa/P1cCart, Inc., owner of all abutting property has requested that the City vacate the above-described utility easement, as sYiown on the attached map. The subject easement, acquired by dedication, is open, but contains no utility facilities. The subject vacation request is made in order to utilize the vacated easement area to expand the buildable area and provide more usable yard space within the subject property. The required and appropriate monetary consideration has been placed in escrow witf~ tt)e Real Property Department of the City. Reviewing City departments and private utility companies have raised no objec- tions to this request. A satisfactory replat, dedicating all required easements, has been submitted.
