AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR
AND CITY SECRETARY OF THE CITY OF FORT WORTH TO
EXECUTE AND DELIVER A DEED CONVEYING TO TEXAS
CHRISTIAN UNIVERSITY FOR EDUCATIONAL PURPOSES
106.446 ACRES OF LAND, ENOWN AS THE WORTH HILLS
GOLF COURSE, FOR A CONSIDERATION OF SIXTY-FIVE
HUNDRED DOLLARS ($6,500.00) PER ACRE; AND NAMING
AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, on the
18th day of August, 1961, in strict compliance with the appli-
cable provisions of Article 1015c of the Revised Civil Statutes
of the State of Texas, duly adopted Ordinance No. 4509, which
ordinance provided for the holding of an election on September
12, 1961, of the qualified voters of the City of Fort Worth to
determine whether or not the City of Fort Worth, Texas, through
its City Council, should be authorized to sell to Texas Chris-
tian University for educational purposes all or part of approxi-
mately one hundred and six (106) acres of land, known as the
Worth Hills Golf Course, for a consideration of Sixty-five Hun-
dred Dollars ($6,500.00) per acre; and,
WHEREAS, said election was duly and legally held on the 12th
day of September, 1961; and,
WHEREAS, on the 15th day of September, the return day of
said election, at a regular, open meeting of the City Council
of the City of Fort Worth, the votes cast at said election were
tabulated and the official result thereof was declared favor-
ing such sale; and,
WHEREAS, ten thousand, five hundred and thirty (10,530) votes
were cast "For the Sale" and four thousand, five hundred and
sixteen (4,516) were cast "Against the Sale"; and,
WHEREAS, on July 25, 1962, the Supreme Court of Texas, in
the case of Carter et al. vs. City of Fort Worth et al., No.
A-9115, refused application for writ of error to the Court
of Civil Appeals for the Second Supreme Judicial District of
Texas, at Fort Worth, with the notation "No motion for rehear-
ing will be entertained," thus finally disposing of said cause
which was an unsuccessful injunction proceeding to enjoin said
sale and conveyance by the City of Fort Worth to Texas Chris-
tian University, the opinion of the Court of Civil Appeals
being reported in 357 S. W. 2d at page 581, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the Mayor and City Secretary of the City of Fort Worth
be and the same are hereby expressly authorized, empowered
and directed to execute and deliver in the name of the City of
Fort Worth a good and sufficient deed conveying to Texas Chris-
tian University, a corporation, for educational purposes, the
hereinafter described real property in consideration of the
payment in cash money of Sixty-five Hundred Dollars ($6,500.00)
per acre for said real property:
Parts of the Adam Vogt Survey, Abstract No. 1585,
the James Smith Survey, Abstract No. 1382, and the
Thomas B. Taylor Survey, Abstract No. 1539, situated
about 4 miles south 25 degrees west from the Court-
house in Fort Worth, in Tarrant County, Texas, and em-
bracing the tract conveyed to the City of Fort Worth
by a deed recorded in Vol. 798, page 314, of the Deed
Records of Tarrant County, Texas, and also embracing
a portion of the 106.4 acres tract conveyed to the City
of Fort Worth by a deed recorded in Vol. 777, page 455,
of said Deed Records:
Beginning at a galvanized iron rod in the south line
of said A. Vogt Survey and 500.6 varas from its south-
east corner, and being the southwest corner of said
106.4 acres tract and the west corner of the tract
conveyed to the City of Fort Worth by said deed re-
corded in Vol. 798, page 314, of said Deed Records of
Tarrant County, Texas;
Thence north no degrees 07 minutes east, along the
most westerly west line of said 106.4 acres tract,
847.2 feet to an iron rod;
Thence north 14 degrees 53 minutes east 67.9 feet
to an iron rod;
Thence north 24 degrees 20 minutes east 80 feet to
an iron rod;
Thence north 34 degrees 09 minutes east 100 feet to
a stake;
Thence north 18 degrees 34 minutes east 54.5 feet to
an iron rod;
Thence north 9 degrees 28 minutes east 50 feet to
an iron rod;
Thence north 1 degree 47 minutes east 300 feet to an
iron rod;
Thence north 7 degrees 35 minutes east 50 feet to
an iron rod;
Thence north 35 degrees 06 minutes east 25 feet to
an iron rod;
Thence north 59 degrees 08 minutes east 25 feet to
an iron rod set in the westerly north line of said 106.4
acres tract and 182 feet from its west-northwest corner;
Thence south 89 degrees 40 minutes east, along said
line, 2443.5 feet to a stake, a reentrant corner of
said 106.4 acres tract;
Thence north no degrees 20 minutes east 352.2 feet
to a galvanized iron rod, the north-northwest corner of
said tract;
Thence south 89 degrees 40 minutes east 298 feet to
a one inch iron rod set in the northerly north line of
said tract;
Thence south 1202.4 feet to an iron rod;
Thence south 3 degrees 01 minute west 100 feet to
an iron rod;
Thence south 7 degrees 50 minutes west 100 feet to an
iron rod;
Thence south 13 degrees 46 minutes west 100 feet to
an iron rod;
Thence south 15 degrees 22 minutes west 56.7 feet to
an iron rod;
Thence south 49 degrees 44 minutes west 36.5 feet to a
galvanized iron rod;
Thence south no degrees 16 minutes west 76 feet to
an iron rod;
Thence south 3 degrees 58 minutes west 67.9 feet to
an iron rod;
Thence south 17 degrees 53 minutes west 190 feet to
a galvanized iron rod in the north line of the T. B.
Taylor Survey, the most easterly corner of the tract con-
veyed to the City of Fort Worth by said deed recorded in
Vol. 798, page 314, of the Deed Records of Tarrant County,
Texas;
Thence along a curve to the right, with a radius of
57.36 feet, a distance of 72.46 feet to the end of
said curve,-

to a galvanized iron rod, the beginning of a curve to
the right with a radius of 40 feet;
Thence along said curve 62.7 feet to the place of be-
ginning, and containing 106.446 acres.
SECTION 2.
That this ordinance shall be in full force and effect from
and after the date of its passage, and it is so ordained.

Re: Purchase of 106.446 acres of land by
Texas Christian University (Worth
Hills Golf Course land).
Gentlemen:
Texas Christian University is purchasing the 106.446 acres of land
at $6,500 an acre. There are details concerning the purchase that
your and our attorneys thought unnecessary to put in the deed and
are covered in this letter.
Possession
Under our present contract for purchase of this land, the City of
Fort worth had the right to retain possession of the property for
up to twelve months from the date of the contract. This twelve
month period will expire February 27, 1963. The city, of course,
has the right to retain possession until that time.
However, Texas Christian University must make certain plans and
appropriations for use of the land which will require some time.
As matters appear now, we believe that we will be able to leave
the city in possession until sometime during the summer of next
year.
Accordingly, if the city does not wish to turn over possession by
February 27, 1963, we will be pleased to work with the city and
make a satisfactory arrangement to delay delivery of possession
until some date selected by the city during the summer of 1963.
The extended time can be on a nominal lease basis which will give
you the use of the land until possession is finally delivered to
us, but will protect us as owners. In other words, the lease
might be for $1.00 or on such other terms as will not profit
Texas Christian University but will protect TCU as owners, as
your attorney and our attorney might work out.

Texas Christian University, at its expense, as the contract re-
quired, had the property surveyed. The surveyors did their best
to designate approximate locations of sanitary sewer mains and
sewer lines existing under the land. The city, of course, will
retain and is hereby given an easement to service, at city ex-
pense, any existing sanitary sewer mains as well as any water
mains, if any, that lie under the property.
If, due to improvements that TCU want to construct in the future,
TCU should request the city to move or relocate these mains, the
expense of relocating them will, of course, be on TCU. If the
city should wish to move or relocate them for other purposes, we
would assume that the expenses would be on the city; and TCU will
in the future as in the past be cooperative in trying to facilitate
such matters.
