ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING TWO 50' SANITARY SEWER EASEMENTS, ONE 30'
DRAINAGE AND UTILITY RIGHT-OF-WAY AND ONE 25' DRAINAGE AND
UTILITY EASEMENT, AS MORE PARTICULARLY DESCRIBED HEREIN;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That the two 50' sanitary sewer easements, one 30' drainage and
utility right-of-way and one 25' drainage and utility easement
described more particularly in the attached Exhibit "A" which is
incorporated. herein by reference be and the same are vacated,
abandoned and permanently closed and extinguished.
SECTION 2.
That the fee and the„;,easement interests described above are
hereby released and shall revert to the adjacent owners as provided

by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

BEING 2 - 50 foot Sanitary Sewer Easements, 1 - 30 foot drainage
and utility right-of-way and 1 - 25 foot drainage and utility easement
all recorded in Deed Volume 388/35, Page 23 County Records, Tarrant County,
Texas,situated in the A J Huitt Survey, abstract No 709, City of Fort Worth,
Tarrant County, Texas and being a portion of Tract Pao 1 as described by Deed to
Shell Oil Company and recorded in Deed Volume 7976, Page 550, said County Records,
those easements and right-of-way being more particularly described by metes and
bounds as follows

1) BEGINNING at a point in the westerly line of said Tract No 1 Shell
Oil Company and the easterly line of Block 13, Huntington Place Addition as
recorded in Plat Volume 388/38, Page 41, said County Records said point being
N 16° 39' 49" W, 8.77 feet from the most easterly corner of Lot 19, Block 13,

Recommendation:
It is recommended that the City Council adopt an ordinance vacating two 50' wide
sanitary sewer easements and a 55' wide drainage and utility easement, all
recorded in Volume 388/35, Page 23, D.R.T.C.T., 25' situated in the A. J. Huitt
Survey, Abstract IVo. 709, City of Fort Worth, Tarrant County, Texas, and being a
portion of Tract No. 1, as described by Deed to Shell Oil Company and recorded in
Volume 7976, Pag 550, D.R.T.C.T.
Discussion
Shell Oil Company (Robert Ryan), Erwin Higginbotham, Samuel Wade, Joe W.
Ridlehuber, Walter Brandon & George B. Whiticar, owners of all abutting property,
have requested that the City vacate the two 50' wide sanitary sewer easements and
a 55' wide drainage and utility easement, as described in the paragraph above,
and as shown on the attached map. The subject easements, acquired by plat, are
.existing and contain a sanitary sewer line. The vacation request is made in
order to replat the vacated right-of-way with the adjoining property, thus
expanding the building area and providing more usable yard space.
It is the opinion of the Real Property Department of the City that the rights and
interest of the City in the subject easements will be served with the dedication
of replacement easements on the required replat with the adjoining property.
Reviewing City departments and private utility companies have raised no
objections to the request, subject to the vacated easements being replatted with
adjoining property and replacement easements being retained on the replat. A
satisfactory replat has been submitted.
