ORDINANCE NO. ~~
AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISH-
ING A PORTION OF THE 10-FOOT WIDE EAST/WEST UTILITY EASE-
MENT LOCATED ALONG THE COMMON PROPERTY LINE OF LOTS 7 AND
8, BLOCK 21, NORTH RIVERSIDE ESTATES ADDITION; VACATING,
ABANDONING, CLOSING AND° EXTINGUISHING THE 3500 BLOCK OF
LAKELAND STREET, LOCATED BETWEEN REGAL ROAD AND CINDY
DRIVE; PROVIDING FOR REVERSION OF FEE IN SAID LANDS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS;
SECTION 1.
THAT the following be and the same are vacated, abandoned and
permanently closed and extinguished as a utility easement and public
street right-of-way, respectively:
A. A portion of the 10-foot wide east/west utility ease-
ment located along the common property line of Lots 7
and 8, Block 21, North Riverside Estates Addition,
said portion being more particularly described in
Exhibit "A", attached hereto and incorporated herein;
and
B. The 3500 block of Lakeland Street, a public street
right-of-way, from the north right-of-way line of
Cindy Drive north to the south right-of-way line of
Regal Road.
SECTION 2.
That the fee to the lands in the above described vacated utili-
ty easement and public street right-of-way is hereby released and
shall revert to the adjacent owner as provided by law, SAVE AND
EXCEPT that easements are retained for any and all existing util-
ities.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Rev. A. F. Jennings, on behalf of the Lakeland Baptist Church, owner of all
abutting property, has requested that the City vacate the fallowing:
1) The westerly 74.11' of a 10' east/west utility easement located along the
cornmon property line of Lots 7 & 8, Block 21, North Riverside Estates
Addition; and,
2) The 3500 block of Lakeland Street located between Regal Read .and Cindy
Drive; all as shown on the attached map.
The subject street right-of-way and utility easement, acquired by dedication,
contain street light, telephone and electric utility facilities. The subject
request has been submitted in order to replat the vacated right-af-way and
easement with adjacent property in order to expand the building area and .pro-
vide more useable yard space.
The necessary and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
Reviewing City departments and private utility companies have raised na objec-
tions to this request provided xhe subject right-of-way and utility easement
are replotted with adjacent property, and the necessary utility easements are
retained for any existing facilities. A satisfactory replat has been sub-
mitted.
The City Plan Commission has reviewed this request and recommends that the sub°
ject street right-of-way and utility easement be vacated, as requested.
Recommendation
It is recommended that an ordinance be adopted vacating the following.
1) The westerly 74.11' of a lU' wide east/west utility easement located along
the common property line of Lots 7 & 8, Block 21, North Riverside Estates
Addition, and,
2) The 3500 block of Lakeland Street located between Regal Road & Cindy
Drive,
