.,; ~ci'p' „^~' '_7 z~ ]~ ~ a ~ ' ~ 1 ORDINANCE NO. /~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A 23-FOOT WIDE PORTION OF THE 5700 BLOCK OF BRENTWOOD STAIR ROAD (FORMERLY EDERVILLE ROAD), FROM THE SOUTHEAST CORNER OF LOT 1, BLOCK 1, LAMPLIGHTER ADDITION, NORTHEASTERLY 180 FEET TO THE SOUTHEAST CORNER OF TRACT 2-D, E. JONES SURVEY; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. THAT a 23-foot wide portion of the 5700 block of Brentwood Stair Road (formerly Ederville Road), from the southeast corner of Lot 1, Block 1, Lamplighter Addition, northeasterly 180 feet to the southeast corner of Tract 2-D, E. Jones Survey, said portion being more particularly described in Exhibit "A", attached hereto and i incorporated herein, be and the same is vacated, abandoned and per- manently closed and extinguished as a public street right-of-way. SECTION 2. That the fee to the land in the above described vacated public street right-of-way is hereby released and shall revert to the adja- cent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Jones PAGE , NUMBER Survey, Tract 2-D ('V-84-89) 1 oF~F3,i5/85 **1'Z=1331 f c1....... ~,.~P~t,.3 Betty Dickezts, owner of all abutting property, has requested that the City va- '` cute a portion of the 5700 block of Brentwood Stair Road (formerly Ederville Road) a width of 23' from the southeast corner of Lot 1, Block 1, Lamplighter Addition, nor"theasterly 180' to the southeast corner of Tract Z-D, E. Jones Survey, as shown on the attached map. The subject right=of-way, acquired by dedication, consists of landscaped park- way which contains sf~.reet light, electric, and telephone utility facilities. The subject vacation request is made in order to replat the vacated right-of- way with ad3oinirig property, thus expanding the building area and providing more usable yard Space. The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objet- tions to thi$ request, subject to the vacated right-of-way being replotted with adjacent property; the vacated right-af-way being retained as a utility ease- ment for existing utility facilities, unless other satisfactory arrangements are made; and the required replat substantiates thaC sufficient right-of-way remains in order to accommodate a 10' wide parkway from the new property line to the new curb. A satisfactory replat has been submitted. TI1e Gty p~.an ~omayssion has reviewed this request and recommends that the sub- ject street right==af-way be vacated as requested.
