ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF RIVERCREST DRIVE
AND PORTIONS OF SUNDRY OTIiE~t STREETS , AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS9 DECLARING THE CONTRACT WITH
S R 0 Asphalt Inc FOR THE CONSTRUCTION OI'
SAID IMPROVEMENTS FULLY COMPUTED AND PERFORMEDe DIRECTING THE
ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUIJDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OY' SAID ASSESSMENTS;
DIRECTING THE CYTY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE
BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITX
COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECORDS OF SAID CITYg AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texan, has heretofore entered into a contract
wtith 5..~°.0. Asphalt, Inc. , for the malting and construction of
certain street improvements on the hereinafter described portions of streets, avenues and
public places in said City, to®~ita
RIVERCREST DRIVE From Hazelwood Drive - North to Cul-De-Sac, known and
designated as Project No. 029-040110, Unit II, a five-
inch thick hot-mix asphaltic concrete pavement with
seven-inch high concrete. curb and eighteen-inch wide
concrete gutter on a six-inch thick lime stabilized sub-
grade, so that the finished roadway will be thirty-feet
wide: Six-inch thick concrete driveway approaches will
be constructed where specified..

ti~~HENEAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 9141 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHEH:r;AS, the City Council of the City of Fort ~~orth, Texas, has, upon review,
found and determined that, in same instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 9141 , and
WHEtiP;Ad, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

BE IN ONDAIIdLD BY THE CITY COUNCIL OF THE CITY OF FONT WONTH,

I.
The improvement-s on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and perfornned.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance Frith
the proceedings relating to such improvements and assessments, The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective. credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
prices
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, 1°~xas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.

Final measured quantities at contract unit prices yield an earned total price
for this contract of $280,605.93 which is $20,316.07 (6.75X) under the bid
price. The underrun is the result of differences between quantities estimated
for the contract documents and quantities actually used to complete the work.
