ORDINANCE NO . ~.~~.~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING ALL RIGHTS AND INTEREST OF THE CITY OF FORT WORTH IN AND TO A CERTAIN 0.225 ACRE TRACT OF LAND, DESCRIBED MORE SPECIFICALLY HEREIN, COMPRISING A PART OF THE RIGHT- OF-WAY AND STREET KNOWN AS TULSA WAY IN THE HI-MOUNT ADDITION TO THE CITY OF FORT WORTH; RETAINING UTILITY EASEMENTS; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That all rights and interest of the City of Fort Worth in and to that certain 0.225-acre tract of land described more specifically in Exhibit "A" attached hereto and incorporated by reference herein for all purposes, said land comprising a part of the right-of-way and street known as Tulsa Way in the Hi-Mount Addition to the City of Fort Worth, be and the same is vacated, abandoned and permanently closed and extinguished as a part of the street and right-of-way known as Tulsa Way. SECTION 2. That the fee to the lands in the vacated portion of the Tulsa Way right-of-way described above is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities on, over or within the vacated portion of the Tulsa Way right-of-way described above. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it~~ is so or- dained. Discussion Craig Simpson, on behalf of the tlcDonald's Corp. and the Mobil Foundation, Inc., owners of abutting property, have reyuested that the City vacate the above des- cribed portion of street right-of-way, as shown on the attached map. The subject street right-of-way, acquired by dedication, is open on the ground, improved, and contains water, sewer, and an electric signal light facilities. The subject regr.iest is made in order to replat the vacated right-of-way with ad- jacent property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has keen placed in escrow with the Real Property Department of the Citye Reviewing City departments and private utility companies hvae raised no objec- tions to this request, subject to the vacated right-of-way being replatted with adjacent property, and a portion of the vacated right-of-way being retained as a utility easement for existing utility facilities, ul~less other satisfactory arrangements are made. A satisfactory replat has been slahn?itted. The City P1 an Commission has reviewed this reycrest and recommends tt?at the sub- ject portion of the street right-of-way be vacated as reyuested.
