ORDINANCE NO. ~~ "
AN ORDINANCE ORDERING AN ELECTION OF THE QUALI-
FIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, ON
SATURDAY, THE 6TH DAY OF APRIL, A.D. 1985, FOR
THE PURPOSE OF ELECTING THE MAYOR AND COUNCIL-
MEMBERS FOR THE CITY OF FORT WORTH, TEXAS; PRO-
VIDING A SEVERABILITY CLAUSE; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That, in compliance with the Charter of the City of Fort Worth
and in accordance with the Constitution and laws of the State of
Texas, an election be and the same is hereby called and ordered for
Saturday, April 6th, A.D. 1985, as authorized by Article 2.01 b,
Election Code of the State of Texas, at which election all qualified
voters may vote for the purpose of electing a Mayor at large and
eight (8) Councilmembers from their respective districts.
SECTION II.
That the City Secretary of said City shall prepare ballots to
be used in voting machines in said election, on which ballots shall
be printed the names of the candidates for the at-large position of
Mayor and the names of the candidates from the respective single
member districts for the position of Councilmember. The places of
the different candidates shall be designated on the official ballot
as Mayor and Member of Council, Districts 2, 3, 4, 5, 6, 7, 8 and 9,
respectively. City Council single member districts are described and

defined in Ordinance Nos. 7323, 7392, 7441, 7869, 7963, 8047, 8261,
8682, 8712, 8719, 8909 and 9304.
SECTION III.
That no person's name shall be placed on the official ballot as
a candidate for the office of Mayor or as a member of the City
Council unless such person has filed his sworn application, as re-
quired by the laws of Texas, with the Mayor and the City Secretary
at least thirty (30) days prior to the election date. There must
also appear on the face of said application the single member dis-
trict wherein said candid ate resides and from which district said
candidate is seeking election, except that, with respect to candi-

dates for the office of Mayor, the election shall be at large. That
no person's name shall be placed on the official ballot as a candi-
date for the office of Mayor unless such person is a qualified resi-
dent elector of the City of Fort Worth and shall have resided within
the City for a period of at least six (6) months next preceding
April 6, 1985, the date of the election. That no person's name shall
be placed on the official ballot as a candidate for membership on
the City Council unless such person is a qualified elector of the
City and shall have resided in the district from which he seeks
election for a period of at least six (6) months next preceding
April 6, 7985, the date of the election. In determining whether a
person has complied with the durational residency requirements
established by this ordinance and the City Charter for the office of
Mayor or City Councilmember, the provisions of Subdivisions 3 and 6
of Article 1.05 of the Texas Election Code shall apply.
SECTION IV.
That it shall further appear to the said City Secretary, before
said candidate's name is entered on said ballot, that he has filed
an affidavit of loyalty with the City Secretary, as required by
Article 6.02 of the Election Code of the State of Texas, as amended.
SECTION V.
That, in the event that there are two or more candidates for
the office of Mayor or two or more candidates from the same single
member district for membership on the City Council, the order in
which the names of such candidates are to be printed on the ballot
shall be determined by a drawing to be conducted by the City
Secretary; that three (3) days prior to the date on which the draw-
ing is to be held the City Secretary shall post a notice in the City
Hall of the time and place of the drawing and shall also give per-
sonal notice to any candidate who makes written request therefor and
furnishes to the City Secretary a self-addressed stamped envelope;
and that each candidate involved in the drawing or a representa-
tive designated by him shall have a right to be present and observe
the drawing.

SECTION VI.
That absentee voting shall be conducted by two methods:
(1 ) Voting by personal appearance at the Fort Worth
City Hall, 1000 Throckmorton Street, Fort Worth,
Texas 76102, and
(2 ) Voting by mail.
That absentee voting shall be on paper ballots and that each
absentee voter shall vote for his choice for candidate for Mayor and
for each place as a member of the City Council by placing an "x" in
the square beside the name of each candidate for whom he wishes to
vote; provided, however, that, if the voter places a plus sign (+)
or a check mark (~) or any other mark, which clearly shows his in-
tention, in such place, it shall be counted as a vote for that can-
didate, provided that no more names are thus marked than there are
places to be filled. That the failure of a voter to mark his ballot
in strict conformity with these directions or failure to vote a full
ballot shall not invalidate the ballot, and the ballot shall be
counted on all races wherein the intention of the voter is clearly
ascertainable, except where the law expressly prohibits the counting
of the ballot. That it is specifically provided that the election
officers shall not refuse to count an absentee ballot because of the
voter having marked his ballot by scratching out the names of candi-
dates for whom he does not wish to vote; and that in this connection
the attention of the Absentee Ballot Canvassing Board is directed to
the provisions of Article 6.06 of the Election Code of the State of
Texas.
SECTION VII.
That voting machines approved by the Commissioners' Court of
Tarrant County, Texas, shall be used at the City Council election on
April 6, 1985, in strict compliance with the applicable provisions
of Article 7.14 of the Election Code of the State of Texas, as
amended, and other applicable provisions of such Election Code.
SECTION VIII.
That any candidate receiving a majority of all the votes cast
for the office for which he is a candidate shall be elected to such

office; but that, in the event of a tie or in the event that no can-
dilate receives a majority of all the votes cast for the office
sought, the Mayor, on the first day after the completion of the
official tabulation and canvass of the returns, shall issue a call,
proclamation and notice for a second election, as required by law,
to be held on the second Saturday after the first election to fill
that place, at which second election the two candidates receiving
the highest number of votes for any such office or offices, as the
case may be, in the first election, at which no one was elected by
receiving a majority of all the votes cast for all candidates for
such office or offices, shall again be voted for.
SECTION IX.
That the polls shall be kept oper

SECTION x.
That this ordinance shall constitute the proclamation, call,
notice and ordinance calling and ordering said election; that same
shall be published at least one time, in English and in Spanish, not
more than 25 days nor less then 10 days before the election, in at
least one daily newspaper published in the City of Fort Worth; or
that the City Secretary is hereby directed to post or cause to be
posted said proclamation, call, notice and ordinance in each voting
precinct, or at the polling place of combined voting precincts, at
least twenty (20) days before said election.
SECTION XI.
That the polling places for this election, the personnel or the
officers who are to hold the same and the Absentee Ballot Canvassing
Board, except insofar as they may be changed by the City Council of
said City, shall be as follows:

Only qualified electors residing within the boundary of
District No. 2 shall be eligible to vote for a candidate for Member
of Council, Place No. 2. Only qualified electors residing within the
boundary of District No. 3 shall be eligible to vote for a candidate
for Member of Council, Place No. 3. Only qualified electors residing
within the boundary of District No. 4 shall be eligible to vote for
a candidate for Member of Council, Place No. 4. Only qualified
electors residing within the boundary of District No. 5 shall be

eligible to vote for a candidate for Member of Council, Place
No. 5. Only qualified electors residing within the boundary of

No qualified elector of the City shall be eligible to vote for
a candidate for Member of the City Council of the City of Fort Worth
from other than the district of residency of such elector. All qual-
ified electors of the City shall be eligible to vote for candidates
for the office of Mayor.
SECTION XIII.
That said election shall be held under the provisions of the
Charter of the City of Fort Worth, Texas, and the Constitution and
laws of the State of Texas insofar as same may be applicable, and
all duly qualified resident electors of each respective single
member district shall be allowed to vote in the mayoralty election
on candidates for the office of Mayor. Each and every candidate for
Mayor or Member of the City Council of the City of Fort Worth shall
be a qualified elector of the City. In addition, each candidate for
Member of Council, Place Nos. 2, 3, 4, 5, 6, 7, 8 and 9, shall be a
resident of and shall have resided in the district from which
election is sought for a period of at least six (6) months next
preceding the date of the City Council election.
SECTION XIV.
That the City Secretary is hereby ordered and directed to
prepare and issue ballots for absentee voting and for voting
machines and to stamp same "Official Ballot."

SECTION XV.
That the City Secretary of the City of Fort Worth shall furnish
election officials said ballots and voting machines, together with
any other forms, blanks or instructions in accordance with the
Charter of the City of Fort Worth, Texas, and the laws of the State
of Texas insofar as same are applicable.
SECTION XVI.
That the way and manner of holding this election, the notice to
be given therefor, the polling places, the personnel and the
officers who are to hold same, and all details connected with the
holding of the election shall be provided for and arranged by the
City Secretary; that the proper notice and publication of this
notice, proclamation and ordinance shall only be cumulative of and
in addition to the statutory notice of said election as herein pro-
vided; and that any omission or irregularity in the publication of
this notice, proclamation and ordinance, or in the signing of same,
shall not in any way affect or invalid ate such election.
SECTION XVII.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared void,
ineffective or unconstitutional by a valid judgment or final decree
of a court of competent jurisdiction, such voidness, ineffectiveness
or unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this ordi-
nance, since the same would have been enacted by the City Council
without the incorporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION XVIII.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and

effective date of same in the minutes of the City Council of the
City of Fort Worth and by filing this ordinance in the ordinance
records of said City.
SECTION XIX.
That this ordinance, election order, proclamation and notice
shall take effect and be in full force and effect from and after the
date of its passage, and it is so ordained.

City Councilmembers on April 6, 1985
On February 5, 1985, the Fort Worth City Council adopted Ordinance No. 9305
ordering the election of the Mayor and City Councilmembers on April 6, 1985.
Since the adoption of Ordinance No. 9305, there have been a number of changes
with respect to the election judges and the polling places named in the elec-
tion ordinance. These changes, the reason for each change, and the precinct
affected are as follows:
Precinct Number Reason for Change
1070 The correct name of the polling place for
this precinct is J. P. Moore Elementary
School. Ordinance No. 9305 incorrectly
identified the polling place as the Fort
Worth State School. There is no change in
the address.
1265 The verbal approval to hold the election
at Genesis United Methodist Church at
7635 South Hulen was withdrawn after
Ordinance No. 9305 was adopted. It is pro-
posed that the location of the polling
place for Precinct No. 1265 be changed to
Westminster Presbyterian Church,
7001 Trail Lake Drive. The distance be-
tween the two locations is 1.8 miles.
1291 The election judge named in Ordinance
No. 9305 died after the ordinance was
adopted. It is proposed that the new elec-
tion judge for that precinct be Patricia
Ann Ellis.
4095 The election judge and the alternate elec-
tion judge (John Orr and Diane Orr named
in Ordinance No. 9305 have since withdrawn
their consent to hold the election in this
precinct . The City Secretary has been un-
able to find a replacement for the Orrs.
Therefore, it is proposed that the
location of the polling place for Precinct
No. 4095 be combined with the polling
place for Precinct No. 1081 located at the
University Christian Church, 2720 Univer-
sity Drive. The distance between the two
' locations is four-tenths miles.

City Councilmembers on April 6, 1985
4203 The election judge named in ordinance
No. 9305 has become a candidate for elec-
tion to the City Council. The alternate
judge for this precinct has become his
campaign treasurer. It is proposed to name
Peggy Duncan as the election judge and Jo
Allie as the alternate election judge for
Precinct No• 4203.
4285 At the time Ordinance No. 9305 was
adopted, an alternate judge was not
named. It is proposed that Dorothy Lester
be named alternate judge for Precinct No.
4285.
4288 The election judge named in Ordinance
No• 9305 has since moved from the pre-
cinct. It is proposed that Jesse F.
Pierrard III be named election judge for
Precinct No• 4288.
It is proposed that the City Council repeal Ordinance No. 9305, ordering the
forthcoming Mayor and City Council election, and that the City Council adopt a
new election ordinance incorporating the above described changes.
Recommendation:
It is recommended that the City Council:
1. Adopt the attached ordinance repealing City Ordinance No. 9305, and
2. Simultaneously with the repeal of Ordinance No• 9305, adopt the attached
ordinance ordering the election of the Mayor and City Councilmembers to be
held on April 6, 1985, and incorparating in said election ordinance the
above described changes as to the election judges and the names and loca-
tions of the polling places in certain precincts.
