AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GENERAL CAPITAL PROJECTS FUND IN THE
AMOUNT OF$457,269.00,FROM AVAILABLE FUNDS,FOR THE PURPOSE OF
PROVIDING TRAFFIC SIGNAL MAINTENANCE ON TRAFFIC SIGNALS
OWNED BY TEXAS DEPARTMENT OF TRANSPORTATION; PROVIDING
FOR A SEVERABILITY CLAUSE;MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH;AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
General Capital Projects Fund in the amount of $457,269.00, from available funds, for the purpose of
providing traffic signal maintenance on traffic signals owned by Texas Department of Transportation.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUPPLEMENTAL AGREEMENT NO.1 TO
AGREEMENT FOR THE INSTALLATION AND REIMBURSEMENT
FOR THE OPERATION AND MAINTENANCE OF TRAFFIC SIGNALS
WITHIN A MUNICIPALITY
WHEREAS, on the 26th day of February, 2013, an Agreement for the Installation and
Reimbursement for the Operation and Maintenance of Traffic Signals within a Municipality
was entered into by and between the Texas Department of Transportation hereinafter called
the "State," and the City of Fort Worth, hereinafter called the "City," and subsequently
identified the agreement as Contract Number 02-1XXM5003; and
WHEREAS, the parties to this agreement have mutually determined that it is necessary to
amend the original agreement due to the following reason/reasons: additional intersections
NOW, THEREFORE, Contract No. 02-1XXM5003 is amended as follows:

Article 4. Compensation
The maximum amount payable under this agreement is increased/desrea-se4 from
$198,012.00 to $208,392.00 per year in accordance with the above changes. Calculations
for the increase/decrease to the maximum amount payable are as follows:

ARTICLE 5. Payment
The amount of this supplemental agreement shown above shall be a prorated amount based

any increases or decreases caused by any subsequent supplemental agreements. The
(quarterly) payment shall be adjusted accordingly.

Adopt Appropriation Ordinance for Funds Received from the Texas Department of Transportation in the
Amount of$457,269.00 for Fiscal Years 2015 and 2016, in Accordance with the Texas Department of
Transportation Signal Maintenance Agreement for the Routine Operation and Maintenance of State-Owned
Traffic Signals and for the Non-Routine Repair of State-Owned Traffic Signals (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance to increase estimated
receipts and appropriations in the amount of$457,269.00 in the General Capital Projects Fund for funds
received, in accordance with the Texas Department of Transportation Signal Maintenance Agreement for
the routine operation and maintenance of state-owned traffic signals and for the non-routine repair of
state-owned traffic signals.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to set up appropriations for funds
received from the Texas Department of Transportation (TxDOT) for signal maintenance performed by
Staff in Fiscal Year 2015 in the amount of$198,877.00 and to appropriate funds to be received for
continued maintenance of TxDOT signals for Fiscal Year 2016 in the amount of$258,392.00, in
accordance with the executed Agreement between TxDOT and the City of Fort Worth.
History:
In 1987, the Texas Transportation Commission revised the State's policy that permitted the TxDOT district
offices to establish a method to reimburse cities with a population of over 50,000 for the installation,
operation and maintenance of state-owned traffic signals.
On August 3, 1993, the City Council approved M&C C-13942 authorizing execution of an Agreement
between TxDOT and the City of Fort Worth for TxDOT to pay a portion of the operation and maintenance
costs of state-owned traffic signals within the Fort Worth City limits. Since then, 12 supplemental
Agreements have been executed to reflect additional traffic signal locations.
On November 6, 2012, the City Council approved M&C C-25951 authorizing execution of a new
Agreement consolidating the previous supplemental Agreements into one. On February 26, 2013, the first
supplemental to the Agreement was executed to add six traffic signal locations and to revise the annual
reimbursement amount to $208,392.00.
The Agreement with TxDOT also allows for the City of Fort Worth to seek reimbursement for non-routine
repairs made to damaged state-owned traffic signals that result from crashes or acts of God. The amount
reimbursed annually for non-routine repairs varies but are typically less than $50,000.00.

The Transportation and Public Works Department is responsible for the billing and collection of these
funds.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation funds will be available
in the current capital budget, as appropriated, of the General Capital Projects Fund.
