AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISH- ING THE 20-FOOT WIDE NORTH/SOUTH ALLEY LOCATED BETWEEN BLOCK 13, LAKEVIEW ADDITION, AND BLOCK 79, HIGHLANDS TO GLENWOOD ADDITION, FROM EAST MORPHY STREET SOUTHWARD TO EAST MADDOX AVENUE; VACATING, ABANDONING, CLOSING AND EXTINGUISHING THE 15-FOOT WIDE EAST/WEST ALLEY LOCATED IN BLOCK 79, HIGHLANDS TO GLENWOOD ADDITION, FROM ASH CRESCENT STREET WESTWARD 125 FEET TO THE EAST RIGHT-OF-WAY LINE OF THE AFOREMENTIONED 20-FOOT WIDE NORTH/SOUTH ALLEY; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS; SECTION 1. That the following be and the same are vacated, abandoned and permanently closed and extinguished as public alley rights-of-way: A. The 20-foot wide north/south alley located between Block 13, Lakeview Addition, and Block 79, Highlands to Glenwood Addition, from East Morphy Street south- ward to East Maddox Avenue; and 8. The 15-foot wide east/west alley in Block 79, Highlands to Glenwood Addition, from Ash Crescent Street westward 125 feet to the east right-of-way line of the aforementioned 20-foot wide north/south alley vacated herein. SECTION 2. That the fee to the lands in the above described vacated public alley rights-of-way is hereby released and shall revert to the adj a- cent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dai.ned. Discussion Dalton s Best Made Products, Inc., with the written consent of all abutting property owners, has requested that the City vacate the above described alleys, as shown on the attached map. The subject alley rights-of-way, acquired by dedication, are open on the ground and contain sewer, electric, and telephone utility facilities. The subject vacation request is made in order to replat the subject rights-of-way with adjacent property, thus expandiny the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated alley rights-of-way beiny replatted with abutting property, the required replats to include dedication of easements for existing utility facilities and required drainage facilities, and dedication of 1/2 of 6U' wide rights-of-way for East Morphy Street and East P7addox Avenue. Satisfactory replats have been submitted which comply with the above-stated requirements. The City Plan Commission has reviewed this request, and recommends that the subject alley rights-of-way be vacated as requested.
