AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF$300,000.00
AND DECREASING THE ASSIGNED FUND BALANCE BY THE SAME
AMOUNT,FOR THE PURPOSE OF PROVIDING CONTRACT FUNDS FOR THE
IMPLEMENTATION OF A FORM-BASED CODE AND HISTORIC DISTRICT
AND PROJECT CONTINGENCIES; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
General Fund in the amount of$300,000.00, from available funds, for the purpose of implementing a form-
based code and historic district and project contingencies.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt a Supplemental Appropriation Ordinance in the Amount of$300,000.00 Increasing the Appropriation
in the General Fund by $300,000.00 and Decreasing the Assigned Fund Balance by the Same Amount for
all Associated Project Costs and Authorize Execution of Contract with Code Studio, Inc., to Prepare the
Historic Stockyards Form-Based Code and Historic District Standards and Guidelines Consultant Services
for the Planning and Development Department in an Amount Up to $250,000.00 (COUNCIL DISTRICT 2)
RECOMMENDATION:
|tia recommended that the City Council:
1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the General
Fund by $300,000.00 and decreasing the assigned fund balance by the same amount to cover the cost of
the contract expenses related to the implementation of form-based code and historic district and project
contingencies; and
2. Authorize execution of a contract with Code Studio for Form-Based Code and Historic District
Standards and Guidelines Consultant Services for the Planning and Development Department in the
amount upto $25O.00O.00.
DISCUSSION:
The Planning and Development Department will use this contract to develop a proposed form-based code
and historic district standards and guidelines. These standards and guidelines are meant bzsupersede
the current zoning district and other local land development regulations that apply to the Fort Worth
Stockyards area.
On October 13, 2016, the City Council requested that the City Manager proceed with the creation of a
form-based district and o local historic district designation for the Stockyards. The City Council nominated
o designated area of the Stockyards aomn Historic and Cultural Landmark (HC) [))etriot, in accordance
with Section 4.4O1 Duf the Zoning Ordinance. Nomination ofanHC District and notice thereof toaffected
property owners effectuated interim controls that prohibit the a|teration, demo|ition, or relocations of
properties within the proposed district for a period of 135 days or until the City Council denies the
proposed designation. During the interim period and until such time as the Stockyards HC District
standards and guidelines are adopted by the City Council, the proposed Stockyards HD District is subject
to the Secretary of the Interior's Standards. The 8tookvon]a HC District standards and guidelines will be
prepared in conjunction with the form-based code district standards and guidelines.
On October 27, 2015, the City Council approved M&C PZ-3091 requesting the City Manager to identify
funds for the City to hire a consultant team to create a Stockyards form-based code district and the historic
district standards and guide|inuo, in consultation with property owners and other stakeholders, in an
amount not to exceed $3OO.OUO.0O.

ADVERTISEMENT: A Request for Qualifications (RFQ) was advertised in the Fort Worth Star-Telegram
on Wednesdays between December 16, 2015 and January 14, 2016 with detailed specifications to form-
based code and historic district standards and guidelines consultant services. Forty-three vendors were
solicited from the Purchasing vendor database system and five responses were received. The
qualifications received were reviewed by an evaluation committee consisting of City staff from the
Planning and Development Department and Minority and the Women Business Enterprise Office.
The RFQ evaluation factors included level of experience in preparing municipal form-based codes that
regulate development and redevelopment in other communities, level of experience in preparing historic
preservation design standards that regulate development and redevelopment in other communities, level
of experience and successful efforts in building community consensus through use of the National
Charrette Institute's public participation process, level of expertise of the teams, roles, experience and
availability of key personnel, quality of two comparable projects completed in the past five years and
approach to meeting the SBE Commitment.
PRICE ANALYSIS: The price for the scope of work offered by Code Studio Inc., is $250,000.00. This
amount is consistent with the amount approved by City Council on October 27, 2015. Based on previous
studies and scope, Staff believes that this is a reasonable and fair compensation amount for the scope of
work to be performed. Staff has already spent $5,000.00 on a Historic Resource Survey.
Related costs and expenses are also included in the appropriation related to this contract and shall be
paid by a Change Order not to exceed $45,000.00. It is anticipated that there will be external costs for the
following items:
1) Survey of the boundaries of the historic district and other sub-districts
2) Other project contingencies

ADMINISTRATIVE CHANGE ORDER: An Administrative Change Order or increase may be made by the
City Manager in the amount up to $45,000.00 and does not require specific City Council approval as long
as sufficient funds have been appropriated.
CONTRACT TERMS: Upon City Council's approval, the contract will begin March 30, 2016 and expire on
March 29, 2017, unless terminated earlier in accordance with its terms.
M/WBE OFFICE: Code Studio is in compliance with the City's BDE Ordinance by committing to five
percent SBE participation. The City's SBE goal on this project is five percent.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached supplemental appropriation ordinance funds will be available in the current operating budget, as
appropriated of the General Fund. Upon approval, the assigned fund balance in the General Fund will be
in compliance with the minimum reserve as outlined in the Financial Management Policy.
