HomeMy WebLinkAboutOrdinance 93443 ~ ~ 3 ..a' ORDINANCE N0. ~~ AN ORDINANCE AMENDING ORDINANCE N0. 9160, THE ELECTRICAL CODE OF THE CITY OF FORT WORTH, BY REVISING THE TERMS OF MEMBERS SERVING ON THE ELECTRICAL BOARD; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PRO- VIDING A 5EVERABILITY CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 9160, the Electrical Code of the City of Fort Worth, is hereby amended by revising Section 803 thereof to read as follows: "Section 803. Members appointed to odd-numbered places shall serve terms expiring October 1, 1985. Members appointed to even numbered places shall serve terms which expire October 1, 1986. Thereafter, members shall serve two-year terms. No member shall serve more than three consecutive two-year terms, and the terms of current members of the Board shall be counted toward the limit of terms to be served far purposes of this ordinance. The members shall serve until their successors are appointed. Alternate members may be appointed to act in the absence of one or more regular members." SECTION 2. All members of the Electrical Board previously appointed for terms expiring October 31, 1985, or October 31, 1986, shall be deemed to have been appointed to terms expiring October 1, 1985, or October 1, 1986, respectively, upon the effective date- of this ordi- nance. SECTION 3. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas ( 1 964) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. -~ '~ , . ~~: ~.~ SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. The City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as pro- vided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION 6. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections 1, 2, and 7 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. This ordinance provides for the existence of an Electrical Board and the. appointment of members to the Board• Due to -a typographical error, members of the Board were appointed for terms expiring October 31, every other year. This is in conflict with Section 2-35.1 of the City Code, which provides for a standard expiration date of October 1 for members of City boards and commissions. The City Secretary has recommended that the Electrical Code be amended to con- form to the standard rules and procedures for City boards. The Department of Law has drafted an ordinance for this purpose.
