AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A 26-FOOT WIDE EMERGENCY ACCESS AND UTILITY EASE- MENT AND TWO ASSOCIATED 20-FOOT BY 20-FOOT PUBLIC OPEN SPACE EASEMENTS, ALL OF SAID EASEMENTS BEING LOCATED IN LOT 1, BLOCK 1, WOODHAVEN CROSSROADS III, AS SHOWN ON PLAT RECORDED IN VOLUME 388/149, PAGE 17, DEED RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; PROVIDING FOR RETENTION OF UTILITY EASEMENTS FOR EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. $E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 26-foot wide emergency access and utility easement and two associated 20-foot by 20-foot public open space easements, all of said easements being located in Lot 1, Block 1, Woodhaven Crossroads III, as shown on plat recorded in Volume 388/149, Page 17, Deed Records, Tarrant County, Texas, be, and the same are, vacated, abandoned and permanently closed and extinguished as an emergency access and utility easement and as public open space ease- meats, respectively. SECTION 2. That the fee to the lands in the above described vacated emer- gency access and utility easement and public open space easements is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all ~, existing utilities within the aforesaid emergency access and utilityt/~ easement, including existing water and sewer facilities. Access and y PAGE NI`3~?~'~~%85 **PZ-1333 ti 1 it Easement and Two Public 0 en 1 0+....,]_ NI g ~ OC , Ot - Background Dondi Residential Properties, Inc., being the owner of all abutting property, have requested that the City vacate a 26' wide emergency access and utility esement and two associated 20' x 20' public open space easements, located within the present boundaries of Lot 1, Block 1, Woodhaven Crossroads III, as recorded in Volume 388/149, Page 17, D.R.T.C.T., and as shown on the attached map. The subject three easements, all acquired by dedication, are platted; the emergency access and utility easement contains water and sewer facilities. The subject vacation request is made in order to utilize the vacated easements as part of the subject property, thus expanding the building area and providing more usable yard space. A satisfactory replat (F-84-182) has been submitted showing replacement public, open space easements and retention of that portion of the emergency access and utility easement containing the existing water and sewer facilities. It is the opinion of the Real Property Department that the rights and interest of the City in the subject three easements denoted in this request have no monetary value, if vacated. Other reviewing City Departments and private utility companies have raised no other objections to this request. Recommendation It is recommended that the City Council adopt an Ordinance vacating the 26' wide emergency access and utility easement and the two associated 20' x 20' public open space easements contained within Lot 1, block 1, Woodhaven Crossroads III.
