GRANTING CONSENT TO CREATION OF
FAR NORTH FORT WORTH NIUNICH'AL UTILITY DISTRICT NO. 1
WHEREAS, the owners of land, Lackland Holdings, LLC, ("Owners") within the proposed boundaries
of Far North Fort Worth Municipal Utility District No. 1 (the "District") have filed a Petition Requesting Consent
to the Creation of a Municipal Utility District(the"Petition") requesting consent from the City of Fort Worth (the
"City") to creation of the District to include approximately 741.99 acres (the "Land") located in Tarrant, Denton
and Wise Counties, Texas, described on Exhibit A attached hereto; and
WHEREAS, the Land proposed to be included in the District lies within the extraterritorial jurisdiction
of the City; and
WHEREAS,the District proposes to provide water, sanitary sewer, drainage, roads and other services to
the Land to benefit the District; and
WHEREAS,the City desires to assert its consent to creation of the District and the inclusion within the
District of the Land within the City's extraterritorial jurisdiction in the event the District is created; and
WHEREAS, the purpose of granting consent is to facilitate further discussions and negotiation with the
proponents of the District in conformance with the consent agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
That the City hereby grants its consent to the creation of the District and inclusion within the District of the Land
described in Exhibit A attached hereto within the City's extraterritorial jurisdiction to and specifically conditioned
upon the following:
1. The District shall construct all facilities to serve the Land in accordance with plans and specifications that
have been approved by the City.
2. The City shall have the right to inspect all facilities being constructed by the District.
3. The City shall be the retail water and sewer supplier to the District who shall pay outside city limit rates
and all other charges applicable and the City shall maintain all its rights and privileges under its
Certificate of Necessity and Convenience No. 12311.

4. The City shall be the retail wastewater service provider to the District provided the Trinity River
Authority ("TRA") consents to such service. The Owners shall provide all necessary information and
cooperation necessary for the City to acquire approval from the TRA.
5. The City shall have the right to review and approve the District's bonds and notes prior to issuance and
may place restrictions on the terms and provisions of the District's bond and notes issued to provide
service to the Land and conditions on the sale of the District's bonds and notes to the extent such
restrictions and conditions do not generally render the bond and notes of the District unmarketable, as
defined in the Agreement Concerning Creation and Operation of Far North Fort Worth Municipal Utility
District No. 1.
6. The purposes for which the District may issue bonds shall be limited to the purchase, construction,
acquisition, repair, extension, and improvement of land, easements, works, improvements, facilities,
plants, equipment and appliances necessary to:
i. Provide a water supply for municipal uses, domestic uses, and commercial purposes;
ii. Collect, transport, process, dispose of and control all domestic, industrial, or communal wastes
whether in fluid, solid or composite state;
iii. Gather, conduct, divert and control local storm water or other local harmful excesses of water in
the District and the payment of organization expenses, operation expenses during construction
and interest during construction; and
iv. Design, acquire, construct and finance Road Projects, including thoroughfare, arterial and
collector roads, as defined in the Agreement Concerning Creation and Operation of Far North
Fort Worth Municipal Utility District No. 1.
7. The purposes, powers and duties of the District shall be limited to those expressly authorized for
municipal utility districts pursuant to the Texas Water Code and applicable constitutional provisions. By
approving this resolution, the City does not consent to the financing of facilities designed or utilized to
perform fire-fighting services, or the conversion of the District to any other form of district.
8. The parties may negotiate further and contract, in writing, to modify the foregoing terms and conditions
of the City's consent to the creation and purpose of the District and the inclusion within the District of the
Land.
9. The phrase "consent to creation" as used in this resolution has the meaning provided in Sec. 42.042(d),
Texas Local Government Code, to wit, authorization to initiate proceedings to create the District as
provided in law.
10. The parties may negotiate an east-west arterial roadway that will provide adequate capacity for the
proposed development. A Concept Plan will be submitted that will be phased in such a way that the
number of platted lots will coincide with specific phasing for the arterial roadway construction.

11. A Master Thoroughfare Plan amendment for the east-west arterial roadway will be submitted and
reviewed concurrently with the Concept Plan for the development.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF FORT WORTH that the City Secretary
is hereby directed to file a copy of this resolution in the permanent records of that office.

RECOMMENDATION:
It is recommended that the City Council approve a consent resolution and authorize the City Manager to
execute a Consent Agreement between the City of Fort Worth and Lackland Holdings, LLC.
DISCUSSION:
Lackland Holdings, LLC (Owner), owns and intends to develop approximately 742 acres in Fort Worth's
(City) extraterritorial jurisdiction in Tarrant, Denton and Wise Counties. The property is located east of
U.S. Highway 81/ U.S. Highway 287 and west of Sandera Ranch Boulevard. The eastern boundary is
adjacent to the Fort Worth city limit line. All of the area within the proposed Municipal Utility District
(District) falls within Fort Worth's Certificate of Convenience and Necessity (CCN). Water and wastewater
service currently exists for the Sandera Ranch development to the east and can be extended to the new
development within CCN No. 12311. The City will be the retail water and sewer supplier to the District,
who will pay outside city limit rates and all other applicable charges. The City will also be the wastewater
service provider to the District, pending Trinity River Authority consent.
The City and the Owner are negotiating an east-to-west arterial roadway that will provide adequate
capacity for the proposed development. A concept plan will be submitted that will be phased in such a
way that the number of platted lots will coincide with specific phasing for the arterial roadway
construction. A Master Thoroughfare Plan Amendment for the arterial will be submitted and approved
concurrently with the Concept Plan. The District will be responsible for construction and maintenance of
the arterial roadway.
The consent resolution and Agreement outline basic commitments for the District. Upon approval, the
owner will prepare a concept plan for City Plan Commission approval. The owner will also seek the Trinity
River Authority's Denton Creek Advisory Committee's approval for addition of the District to the sewer
treatment area. The City and the District will continue to negotiate all applicable Agreements as indicated
in the attached Consent Agreement and submit these Agreements to the City Council for approval. At that
time, the owner will bring a preliminary plat to the City Plan Commission for consideration.
The proposed Far North Fort Worth Municipal Utility District No. 1 is located in the Fort Worth ETJ of
Tarrant, Denton and Wise Counties and is in FUTURE COUNCIL DISTRICT 7.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that approval of this Agreement will have no

immediate material effect on City funds. Any effect on expenditures and revenues will be budgeted in
future fiscal years.

TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY:
THE JACK W. WILSON FAMILY TRUST and THE SARAH H. WILSON
TRUST A & B ETAL, holding title to a majority in value of the land described in
Exhibit A attached hereto and incorporated herein for all purposes (the "Property"), as
indicated by the certificates of ownership.provided-by.the Tarrant ,A,ppraisal.District
and the Wise County Appraisal District, acting pursuant to the provisions of
Chapters 49 and 54, Texas Water Code, together with all amendments and additions
thereto, respectfully petition the Commissioners of the Texas Commission on
Environmental Quality (the "TCEQ") for the creation of a municipal utility district, and
in support thereof would respectfully show the following:
I.
The name of the proposed District shall be FAR NORTH FORT WORTH
MUNICIPAL UTILITY DIIS T RIC T NO. 1 (herein the "District"). There is no other
conservation or reclamation district in Tarrant or Wise County, Texas, with the same
name.
II.
The District shall be created and organized under the terms and provisions of
Article XVI, Section 59 of the Texas Constitution and Chapters 49 and 54, Texas Water
Code,together with all amendments and additions thereto.
III.
The District shall have all the rights, powers, privileges, authority and functions
conferred by and be subject to all duties imposed by the Texas Water Code and the
general laws relating to municipal utility districts. The District shall contain an area of

approximately 733.648 acres of land, more or less, situated in Tarrant and Wise
Counties, Texas. All of the land proposed to be included may properly be included in
the District.
M.
The Petitioners hold fee simple title to the Property, as indicated by the
certificates of ownership provided by the Tarrant Appraisal District and the Wise
County Appraisal District.
V.
The Petitioners represent that there are no lienholders on the Property.
VI.
The general nature of the work proposed to be done by the District at the present
time is the purchase, construction, acquisition, maintenance and operation of a
waterworks and sanitary sewer system for commercial purposes, and the construction,
acquisition, improvement, extension, maintenance and operation of works,
improvements, facilities, plants, equipment and appliances helpful or necessary to
provide more adequate drainage for the District, and to control, abate and amend local
storm waters or Other harmful excesses of waters, and road facilities, all as more
particularly described in an engineer's report filed simultaneously with the filing of this
petition, to which reference is hereby made for more detailed description, and such
other purchase, construction, acquisition, improvement, maintenance and operation of
such additional facilities, systems, plants and enterprises, as shall be consistent with all
of the purposes for which the District is created (the "Project").
VII.
There is a necessity for the improvements above described. The territory to be
included in said proposed District will be developed for commercial and residential
purposes. There is not available within the area proposed to be included in the District
an adequate waterworks systern, sanitary sewer system, drainage and storm sewer
system, or road facilities, and the health and welfare of the present and future
inhabitants of the District and of the areas adjacent thereto require the purchase,
construction, acquisition, maintenance and operation of an adequate waterworks
system, sanitary sewer system, and drainage and storm sewer systern, and road
facilities.
VIII.
The proposed improvements are feasible and practicable. There is an ample
supply of water available, and the terrain of the territory to be included in the proposed

District is such that a waterworks system, a sanitary sewer system, drainage and storm
sewer system,and road facilities can be constructed at a reasonable cost.
IX.
A preliminary investigation has been made to determine the cost of the water,
sewer and drainage facilities of the Project and it is now estimated by the Petitioners,
from such information as they have at this time, that the cost of the water, sewer and
drainage facilities of the Project will be approximately$44,855,000.
X:
There is not available within the area proposed to be included in the District
adequate road facilities, and the health and welfare of the present and future
inhabitants of the District and of the areas adjacent thereto require the purchase,
construction, acquisition, maintenance and operation of adequate road facilities. The
proposed improvements are feasible and practicable, and can be constructed at a
reasonable cost.
XI.
A preliminary investigation has been made to determine the cost of the road
facilities of the Project and it is now estimated by the Petitioners, from such information
as they have at this time, that the cost of the road facilities of the Project will be
approximately$12,470,000.

The total cost of the proposed District's projects is estimated by the Petitioners to
be approximately$57,325,000.
WHEREFORE, the Petitioners respectfully pray that this petition be properly
filed, as provided by law, that all interested persons be notified of the procedures for
requesting a public hearing on this petition as required by 30 Tex, Admin. Code
§293.12; that this petition be set for consideration at a date to be fixed in keeping with
the provisions of Chapters 49 and 54, Texas Water Code, and the rules of the TCEQ;
that, if necessary, a hearing be held and notice thereof be given as provided in Chapters
49 and 54, Texas Water Code, and the rules of the TCEQ; that this petition be in all
things granted; that the District be created and five directors thereof appointed to serve
until their successors are duly elected and qualified; and that such other orders, acts,
procedure and relief be granted as are proper and necessary and appropriate to the
creation and organization of the District, as the TCEQ shall deem proper and necessary.
